A member of the City Police will be tried starting this Monday.
He is accused of the crime of
Yahir Ayala
, a 21-year-old barber murdered in 2021 by a shot to the chest during a party in Esteban Echeverría's Buenos Aires party.
The Buenos Aires police officer is
Camilo Farías (23)
, who arrives at the trial detained for the crime of
"homicide aggravated by the use of a firearm
, in real competition with simple homicide committed with a firearm in the degree of repeated attempt."
The initial hearing will take place from 9 a.m. in the Oral Criminal Court (TOC) 7 of Lomas de Zamora, as confirmed by judicial sources.
In addition, they reported that the trial prosecutor will be Silvia Pérez and the lawyer María del Carmen Verdú, from the Coordinator Against Police and Institutional Repression (Correpi),
will represent the victim's family, constituted as an injured individual.
Judges Roberto Conti, Santiago Márquez and Elisa López Moyano will hear
around 35 witnesses during the oral debate.
"It is clear that if this guy had not been free to carry his weapon while off duty, this would not have happened. 80 percent of
the City Police's
trigger-happy
cases occur in situations like this," said the lawyer. Verdú, according to a cable from the Télam news agency.
The last public post on Facebook of Yahir Ariel Ayala (21), murdered at a party in a house in Esteban Echeverría.
In the same episode, which occurred in the early morning of August 30, 2021, the friend who took Farías to the party was also shot dead, who was attacked by a volunteer soldier named Pablo Tolaba, who was sentenced to a suspended sentence for
"excess in legitimate defense."
What happened that night
"Yahir played for the neighborhood club La Realidad and that Sunday he finished a game with his friends, they ate a barbecue on the way back and then they went to continue the celebration at the house of one of the team," Verdú said.
The lawyer announced that she will request a sentence for "aggravated homicide due to abuse of his office", which provides for
life imprisonment.
"All the houses belong to people from the same family. Initially they were at the back, then they ran to the middle house and at one point in the night Farías appeared with his friend, named Elián Behamonde, and three girls, because one of them was known to Yahir," Verdú's story continued.
He added: Behamonde was "alcoholized" and entered "one of the houses to go to the bathroom,
but he started urinating on a bed, a television and the furniture."
According to the case, Tolaba noticed this situation and asked them to leave.
The party then continued
for a few hours without any incident.
"At around five in the morning, the two of them appear again, Farías with the service weapon, with which he started shooting out of nowhere.
He kills Yahir and also wounds four more young people who are going to testify at the trial"
, recalled the lawyer, and emphasized:
"They once again sought revenge."
Faced with this situation, soldier Tolaba took his weapon to defend his friends, wounding the police officer and Behamonde.
Farías was transferred to the Santamarina Hospital in Esteban Echeverría, where he underwent surgery and was admitted out of danger under police custody.
While
his friend was taken to Balestrini, where he finally died the next day.
"Initially, both were accused in the case: Farías for the murder of Yahir and the injuries of his friends and Tolaba for the injuries to Farías and for the homicide of Behamonde," Verdú said.
Later, "at the preliminary trial hearing
the prosecution proposed a shortened trial to the soldier's defense."
Yahir was a barber and "had a project that was cut short with the colleague who was working to rent a place with his own barbershop," according to Verdú.
In addition, he added that Correpi called on his social networks to accompany family and friends to
"scream no more trigger-happy, no more repression
, no to the Chocobar doctrine, no to the Bullrich protocol."
