Many Munich residents pay significantly more rent than they actually have to.
And this despite the fact that they could often save money through the Munich price cap.
But this option is often not used.
Munich – The Bavarian capital is known throughout Germany for its high rental prices.
The horrendous sums often cause a stir and anger among the people of Munich.
What many tenants don't know: They often have a legal right to a lower rent.
The basis for this is the so-called rent brake.
But many people in Munich don't make use of it.
Almost 400 euros less rent thanks to the rent cap

reports, a couple from Schwabing, who did not want to be named, paid significantly more for their apartment than necessary for a long time.
According to information from focus online,
the rent for the newly moved apartment amounted
to 1,740 euros for two and a half rooms.
Thanks to the rent control, the couple was able to reduce their monthly rent by 360 euros.
The spouses even got the money back for the months in which they paid too much rent: a total of 4,330 euros.

they were supported
by the Munich tenants' association, which contacted the couple's landlord.
The Munich rent brake
This regulation states that the rent of a Munich apartment for new rentals may not be more than ten percent above the local comparative rent.
Munich residents can determine the comparative rent using the city's online calculation program.
The price cap applies to all rental agreements concluded in Munich since August 7, 2019.
However, it does not include newly built apartments or extensively modernized apartments.

Tenants often do not take action for fear of disputes with the landlord
Munich residents could save an average of 339 euros on their monthly rent, as

This emerges from a calculation by the online platform “Conny” in 2022.
The portal informs tenants about the rent control and helps them to implement it.
But many Munich residents would still pay more rent than they actually have to, explains the platform's managing director Angela Lutz-Plank to

Some tenants don't even know about the rent control or are afraid of disputes with the landlord, says Lutz-Plank.
Survey about rent control: Munich's third mayor also asks for participation
The fact that many Munich tenants do not use their right to a lower rent is also a concern for the Ludwig Maximilians University in Munich.
A research group of statisticians has therefore now distributed 10,000 flyers throughout Munich, as

informs.
Anyone who takes part in the survey will find out at the end whether they are entitled to the rent control.
That depends on many factors.
It even plays a role whether the tenant has underfloor heating or which windows are in the apartment.

The survey also receives prominent support: According to focus online,
the third mayor of Munich, Verena Dietl (SPD), is calling
on Munich residents to take part in the survey.
“Politically, we can then increase the pressure, especially on the FDP in the federal government, to finally give up the blockade on more tenant protection and implement the agreements in the coalition agreement,” she explains to the online portal.
It remains to be seen whether more tenants will exercise their right to a lower rent in the future.
It is also questionable whether the rent control will be extended.
It is actually supposed to expire next year.
An extension is currently still being debated.
