Apparently out of jealousy, a 37-year-old attacked a bus driver in Freising and inflicted an eight-centimeter-long wound on him.

Now he was in court.

And so the original charge against a 37-year-old from Freising was attempted murder.

On the afternoon of July 9th, the defendant attacked a bus driver at the Freising train station who had just previously driven his wife.

The woman only asked him at which stop she had to get off, the bus driver told the court, visibly perplexed.

He was able to avoid the stabs;

but the incident gave him sleepless nights.

He doesn't understand what he did wrong.

“I would really like an answer.”

Defendant admits assault

After the public prosecutor's office submitted the charges to the regional court, the act was only considered dangerous bodily harm.

The reason: The first criminal chamber assumed that the 37-year-old “voluntarily resigned from attempted murder”.

Since the expected sentence in this case does not exceed four years, the proceedings were referred to the lay judges of the district court - before which the defendant now had to answer.

He had his defense attorney Thomas Krimmel admit the facts.

“He is sorry about the matter.” His client, who had not previously been criminally charged, was in an “exceptional personal situation”.

The injured party, who drives a bus for the city of Freising, rejected a perpetrator-victim settlement, which would have included the handover of 5,000 euros to be offset against further compensation for pain and suffering.

The perpetrator stabbed him twice in the neck

As far as the facts of the case are concerned, the bus driver had gone to the lounge at the train station for a break after the said journey.

At around 3:30 p.m. the man from Freising spoke to him through a window.

He asked him when he was leaving again and whether he knew him.

The bus driver said he didn't know him.

The defendant then replied that he was the husband of the woman he had just spoken to and that he was going to “cut her in the head”.

He pushed the 52-year-old and then took the cutter knife out of his trouser pocket.

He stabbed it twice towards the victim's neck.

Since the driver was able to avoid it, he was caught on the forehead, where he suffered, among other things, an eight centimeter long cut.

After the stabbing attempts, the defendant hit the victim's upper body with his fist.

The wife's statement causes heads to shake

The 52-year-old's statement was largely confirmed by his girlfriend, with whom he had already spoken on the phone during the bus ride.

She didn't understand the argument between the men because they spoke Albanian.

But before that, she clearly heard the defendant's wife asking her boyfriend several times about a stop.

The defendant's wife (34), on the other hand, caused everyone involved in the proceedings to shake their heads with an obvious attempt to exonerate her husband.

While she had remained silent to the police, she now told the court that the bus driver had hit on her.

When her husband picked her up, she told him about it.

Her husband then said that he would tell the bus driver to leave her alone in the future.

He was very calm, said the 34-year-old.

But the bus driver reacted aggressively.

When he finally insulted her, her husband pulled out the cutter knife.

A revision is likely

He heard this variant for the first time, said judge Christian Lederhofer.

“And it deviates significantly from what uninvolved witnesses have described.” Prosecutor Julia Knauer was also not convinced: the defendant may have a jealousy problem.

Defense attorney Krimmel did not want to accept the sentence of three years in prison pronounced by Judge Lederhofer: He had demanded a suspended sentence of two years.

There will probably be a revision.
