The Karlsruhe Higher Regional Court (OLG) overturned an acquittal on Tuesday for coercion in the case of a road blockade by a climate activist.
However, a fundamental decision as to whether coercion was involved in this case was not made, as the decision shows.
The judgment of the Freiburg district court, which acquitted a 32-year-old, was too incomplete to be able to judge this, said the presiding judge.
Karlsruhe - New findings would now have to be made by another chamber of the district court.
The case was referred back to the district court.
The case of a 32-year-old was heard, who was acquitted in November 2022 after he took part in several road blockades organized by the “Last Generation Uprising” alliance.
According to the district court, the actions as such were not reprehensible and therefore not punishable.
This would only have been the case if he had endangered other road users.
The public prosecutor's office appealed against this legal assessment.
