The six prison guards who were suspended from their duties following the death of the security prisoner, Ta'ar Abu Assab, petitioned a court today (Tuesday) against the decision of the prison service against them and claim that this was done without a hearing in violation of the law.
Four months have passed since the opening of the police investigation against 19 prison guards, including Katar unit fighters, on suspicion of violently attacking a security prisoner. Abu Assab died shortly after, some of the prison guards are still suspended from their duties and removed until further notice. Now they demanded in an unusual petition that they submitted to the court to return to their duties, and accuse the senior command staff of the prison service of surrendering to terrorists.
Since the beginning of the investigation in the Prisoner Investigations Unit (YACHS) in Lahab 433, several of the prison guards have been removed from their posts by the police, a removal that is extended from time to time on the initiative of the Shevas. Reasoning The official told the defense attorney that the transfer from their position is temporary until the end of the investigation, but it is not clear if it will end soon.
According to the petition submitted to the court today by six of the guards, it is claimed that their transfer from the position was allegedly tainted by extraneous considerations. The petition states that some of the reasons are "pressure from media criticism and motivation to disavow and remove responsibility of the Shebas for the incident."
In the petition it was stated that according to them "it is reasonable and justified to wait for the results of the investigation and not to pass judgment on the petitioners, especially when the chances of the charges seem extremely slim at this stage".
In an unusual petition they submitted to the court, they demanded to return to their position.

The guards also claim that the SHBS transferred them from their positions without a hearing, contrary to SHBS orders.
"The prison service acted in a discriminatory manner. We did not see that in the incident of the escape from Gilboa prison, the IDF transferred the suspects by default before the results of the investigation were published, but here, when it comes to prison guards and simple fighters, the IDF transfers them from their positions without justification and without due process."
The guards, for their part, continue to deny that they used the violence that led to the death of the prisoner, and acted merely to maintain order in the facility.
"This incident is not the result of any of the guards - and that is as long as it is not proven otherwise," claim the petitioners.
They also added in their petition that "the service in Katzeot is a service in the face of terrorism. Terror that is rife inside the prison and the alerts and the violence and the risk are something that the Israeli Security Service will not dispute."
