Traunstein - In the Traunstein circumstantial evidence trial surrounding the death of the student Hanna, the defense has filed a motion for bias against the court.

The reason for this is an email exchange between the court and the prosecution in which the defendant's potential guilt was discussed.

Before the proceedings can continue, the responsible representative chamber must decide on the application, according to the Traunstein Regional Court's announcement on Tuesday, February 20th.

Regina Rick, the lawyer for the man accused of murder, believes that the trial, which is about to begin closing arguments, needs to be reopened.

“In my opinion, the application for bias should be granted and the process should be reopened,” said Rick.

In a post-investigation file, Rick discovered evidence of an email exchange between the court and the public prosecutor's office about the proceedings, in which both parties discussed the facts and the legal assessment.

“There must have been a conversation about the facts on which the court is based,” Rick explained.

“Agreements between the public prosecutor's office and the court about the legal consequences without involving the defense - in my opinion that's not possible at all.

This suggests that the court was determined at an early stage.”

Student Hanna found dead in Prien: Young woman drowned in river

23-year-old Hanna was found dead in the Prien River on October 3, 2022.

A now 22-year-old has been charged with murder.

The young woman had celebrated that night at the “Eiskeller” club in Aschau and was on her way home early in the morning - she never got there.

In its indictment, the public prosecutor's office is of the opinion that the man attacked Hanna on her way home for sexual reasons, hit her on the head and threw her injured into the Bärbach, which flows into the Prien.

According to the autopsy, the student drowned.

“I am convinced that it was an accident,” emphasizes lawyer Rick.

The defendant remained silent about the allegations during the trial.
