If having a namesake is already a rare thing for many of us, having one with the same date of birth is improbable.

While this may seem funny at first, a resident of Bourges (Cher) paid the price after an administrative confusion, reports the Écho Républicain.

Checked at the wheel of his vehicle on September 6, 2023, the Berruyer holder of a probationary license obtained in 2020 learned from the police that his document was invalidated for lack of points.

He then discovers that he would have lost his points after running a fire or committing speeding violations between September 2022 and February 2023.

Impossible, said the man, who had never been to the North.

He then decided to contact the Cher prefecture.

The latter informs him that the address appearing on his license has been changed, to a home in Grande-Synthe (North).

After several weeks, the prefecture realizes that the man who committed the offenses has the same first name, the same last name, the same date of birth and the same country of birth

as the victim.

The two men are only distinguishable by their middle name and their town of birth: the resident of Bourges is called BM Yaya, while the Northerner is called BM Tahirou.

A pellet from the National Traffic Offenses Bureau

By succeeding in proving that he has not committed any offences, in particular thanks to the model of his vehicle, BM Yaya manages to win his case and recover four points which he will immediately lose a few days later, a new times for no reason.

Unable to practice her job in logistics without a driving license, Yaya even lost her job.

Alain Belhadj, delegate of the defender of rights in Cher, who took a close interest in the case, explains these administrative errors by a virtual permit problem.

As Tahirou is only on French territory temporarily, his Guinean driving license is in reality only a virtual French license, as required by the justice modernization law of November 18, 2016.

But due to an IT tool “not implemented”, his virtual permit was not done at the same time as his residence permit, creating chaos from an administrative point of view.

In addition, “the problem comes from the national traffic offenses office, which chose, on its own, to change the address of Yaya to that of Tahirou,” assures Alain Belhadj.

After several months of battle, Yaya was able to get his driving license back, without Tahirou even being aware of the confusing situation into which he, despite himself, put his “twin”.

Still unemployed, Yaya intends to go to the administrative court to seek compensation from the State.
