The buildings in the new district on Banater Straße are constantly growing in height.

However, a legal dispute over the “OPUS.G” construction project is still smoldering in the background.

Geretsried – The shell of the first construction phase of what is currently the largest residential construction project in the Oberland is complete, and the expansion work is in full swing.

However, there is still a legal dispute smoldering in the background over the Krämmel Group's “OPUS.G” construction project.

The directly adjacent Bauer industrial company filed several lawsuits in autumn 2020 because it feared conflicts with its new neighbors.

770 apartments are to be built in the north of Geretsried

Krämmel wants to build 770 apartments on the former Lorenz site between Banater and Elbestrasse in the Geretsried district of Gartenberg.

342 apartments are already available.

As managing director Korbinian Krämmel reported in an interview with our newspaper at the turn of the year, “expansion work is in full swing”.

Bayern-Heim, a Free State company, has 159 subsidized apartments and 40 privately financed rental apartments; the Krämmel Group wants to sell the remaining 143 units as condominiums.

The courts deal with lawsuits

Meanwhile, Bauer's lawsuits are still pending at the Bavarian Administrative Court and the Bavarian Administrative Court in Munich.

The Administrative Court (VGH) has been dealing with a regulatory review lawsuit since November 2020.

The defendant in the proceedings is the city of Geretsried; the subject of the legal dispute is the project-related development plan for the project.

When asked by our newspaper, the press office said the proceedings had been called several times.

“That means a date for the oral hearing has been set,” a spokesman explains.

“However, the dates had to be dumped because the city entered into supplementary proceedings twice and the plaintiff entrepreneur changed his lawyer once.” Once the proceedings have been completed, the VGH plans to set a new date for the oral hearing this year.

No forecast for the start of sales

At the end of last year, the Krämmel company informed interested parties in a newsletter: For the time being, the properties in the “OPUS.G” district will not be marketed - as reported, Bayern-Heim has acquired 199 apartments that are to be rented out and the rest The Krämmel company wants to sell 143 apartments from the first construction phase.

“The great interest and the numerous reservations made the decision all the more difficult for us not to go into marketing for the time being,” says the letter that has been submitted to the editorial team.

In it, the company also addresses the complaints from the neighboring company.

After incorporating “comprehensive legal expertise,” it became clear “that Bauer Comp Holding’s objections have no substance and therefore will have no impact on our project,” the letter continues.

“At the same time, we are aware that a pending lawsuit can cause uncertainty.”

Furthermore, it is assured that the apartments in the first construction phase will be completed as planned and are expected to be ready for occupancy in spring 2025.

“When we start selling the condominiums depends on several factors,” said Korbinian Krämmel when asked by our newspaper.

“We cannot make any forecast at the moment.” Meanwhile, according to the managing director, construction work is continuing as planned.

“The Silva construction phase is currently being developed, and we are currently preparing the Aqua and Viva construction phases.”

In addition to the regulatory action, there are legal challenges that the Bauer company filed with the Bavarian Administrative Court in Munich in September 2020.

In this case, the Free State, represented by the Bad Tölz-Wolfratshausen district office, is the defendant.

Because of a possible conflict with their legal interests, Krämmel Wohn- und Gewerbebau GmbH was invited, explains Joel Hollaender, judge and press spokesman for the VGH.

The subject of the dispute is the building permits issued by the district office.

There is still no trial date

In this case, too, there is still no trial date.

Hollaender: “Scheduling depends on many factors.” These would particularly include priority and older procedures, the location, the need for an on-site visit and the behavior of those involved.

According to the press spokesman, possible existing effects of other procedures can also play a role.
