Berlin - The government coalition made up of the SPD, Greens and FDP at the federal level stipulated the legalization of cannabis in the coalition agreement in 2021 and presented a key points paper almost twelve months later.

“Drug policy needs to be renewed.

“We want to reform cannabis consumption from a health perspective,” said Federal Health Minister Karl Lauterbach (SPD) about the project.

Legalization in the context of cannabis clubs is to be reviewed after a period of four years.

The focus is on protecting health and young people.

The pilot projects for the commercial distribution of cannabis in licensed shops are initially scheduled to last five years.

Cannabis associations: role models come from Spain and Malta

Initially, the production and distribution of cannabis will primarily take place in cannabis associations.

These are similar to the “Cannabis Social Clubs” that already exist in countries such as Spain and Malta.

These are registered, non-profit associations or cooperatives for the purpose of collective cultivation and distribution of cannabis.

Cultivation in the associations is planned from July 2024.

Cultivation associations need official permission to grow cannabis.

Which rules should apply to cannabis clubs

Membership in multiple associations is not permitted.

The minimum age for membership is 18 years and a residence or permanent residence in Germany is required.

According to the new key points paper, the following rules should apply to members of cannabis associations:

  • Setting a maximum output of 25 grams per day and 50 grams per month

  • A maximum of 30 grams per month and a THC limit of 10 percent for people under 21

  • Distribution of seven seeds or five cuttings to private individuals for their own cultivation

  • Possession of a maximum of 25 grams in public without penalty

  • The approval and control of cultivation and distribution in the clubs should be carried out by state authorities.

  • Mandatory cooperation with addiction prevention and counseling centers

  • Personal liability of the board of directors in the event of “pecuniary damage” or violation of the conditions in the event of intent or gross negligence.
