The dispute between the Dachau district office and the Niederrother hunting school owner Alexander Popanz has been bothering the courts for years.

It's always about animal husbandry regulations, permits and money.

Munich/Niederroth – The legal dispute between the Dachau veterinary office and the hunting school operator Alexander Popanz now fills entire file folders.

They have already met in court several times and exchanges are only made in writing or through lawyers.

On Wednesday, in front of the 23rd Chamber of the Bavarian Administrative Court presided over by Judge Michael Schiffmeyer, the mood was once again tense.

Even if Schiffmeyer tried heroically to find a way out of the never-ending cycle between the authority's decision and a lawsuit against the decision by bogeymen.

That's what it was about on Wednesday: The veterinary office had forced Popanz - now confirmed by the highest court by the Administrative Court - to give up his deer enclosure on the property of his hunting school near Niederroth.

Popanz has now also removed the animals, but what he has not yet done is pay the various notices from the authorities that come with it.

The veterinary office charged - among other things - 358 euros for the notification that Popanz had to give up the enclosure.

The information that he should present a concept of how he intends to dismantle the enclosure should also cost 150 euros.

When, in the eyes of the office, this concept was not presented quickly or exhaustively enough, the office imposed a fine of 500 euros.

The responsible officials then wrote the concept for dismantling the enclosure themselves - and sent out another fine bill for 600 euros.

“This is bullying,” said the businessman Popanz.

His lawyer, Dr., called it “incomprehensible.”

And Judge Schiffmeyer also found that at least the 600 euro fine was questionable.

Because: If the office gives Popanz the freedom to write a concept for dismantling the enclosure, then it shouldn't say afterwards: "He's known to be unreliable, he doesn't want to write it, so we'll take action ourselves!"

Since the red deer no longer existed on the Niederrother site anyway - according to Schiffmeyer, "we're only talking about the past here" - he suggested an amicable agreement.

It looked like this: the Popanz veterinary office issued two notices of 150 euros each.

The question of whether a trip by the official veterinarian Dr.

Ursula Halla to Niederroth and the associated written examination may cost 358 euros is now “at the discretion of the judge”.

He will also, as Schiffmeyer called it, “reason” whether the fine of 600 euros was justified.

But Popanz will have to pay the notice of 500 euros.

But the more important part of the hearing yesterday was the look into the future, which Schiffmeyer insisted on in view of the past years full of legal disputes.

There is currently another case pending at the administrative court regarding whether Popanz is allowed to “display” animals as part of his hunting school.

After removing the deer, Popanz acquired Sika game, which is smaller than red deer.

He also keeps wild boars.

Official veterinarian Halla, who was represented in court by district office employee Claudia Huber and department head Dr.

Michael Holland was supported and is convinced that the animals would be used and exploited commercially.

The fact that Popanz also kills and breaks up individual Sika game in front of the hunters as part of his hunting courses, as it is called in technical language, is also absolutely “inadmissible”.

Because: Popanz' Sika-Wild no longer lives freely in the forest and is therefore not “killed”.

Instead, we are talking about “farm animals” whose killing and opening would require completely different rules!

At this point, Judge Schiffmeyer took a deep breath and made a fiery plea: He did not want to “sound didactic or condescending.”

But if there is to be even a rudimentary agreement between the two sides in the future, we must finally cooperate and Buganz should no longer be “offended”!

After all, all parties are concerned with animals and animal welfare!

And there, “the hunter is under the thumb of the animal protection authority”.

Popanz's lawyer Michael Jobst signaled his willingness to accommodate.

What if his client continued to show the animals to the hunting students but didn't leave again?

Veterinarian Halla also explained in a conciliatory manner that the six females and the male in the Sika enclosure as well as the three wild boars were “well looked after” and that Popanz “certainly has specialist knowledge in the craft of hunting”.

In the end, the judge thought her offer that Popanz could come to the office for a “personal meeting” was great.
