Die Klimastiftung MV war von Anfang an umstritten. Vor allem, weil sich gegründet wurde, um die Gasleitung Nord Stream 2 fertigzustellen. Sie aufzulösen, wie auch vom Landtag gefordert, geht nicht.
Schwerin - Die mit Geld aus Russland finanzierte Stiftung Klima- und Umweltschutz Mecklenburg-Vorpommern kann trotz gegenteiligen Beschlusses des Landtags bestehen bleiben. „Aufgrund der geltenden Rechtslage besteht keine Möglichkeit, die Stiftung aufzulösen oder auf andere Weise durch den Vorstand oder die Stiftungsaufsicht zu beenden“, heißt es in einem am Donnerstag in Schwerin von Rechtsanwalt Andreas Urban vorgestellten Gutachten. Landtagspräsidentin Birgit Hesse hatte im November 2023 die nochmalige rechtliche Prüfung bei einer renommierten Anwaltskanzlei mit Hauptsitz in Düsseldorf in Auftrag gegeben, um den Dauerstreit im Parlament zu dem Thema zu befrieden.
Die Stiftung ist politisch heftig umstritten, weil sie auch gegründet worden war, um die Fertigstellung der russisch-deutschen Gasleitung Nord Stream 2 durch die Ostsee zu ermöglichen.
Hesse sagte, ihr Ziel sei es, dass der Landtag nun gemeinsam mit der Landesregierung und dem Stiftungsvorstand einen Weg für eine einvernehmliche Lösung finde. „Für diesen Weg stehe ich auch weiterhin zur Verfügung“, betonte sie. Doch machten die Reaktionen aus den Reihen der Oppositionsparteien bereits deutlich, dass eine Einigung in der Frage eher unwahrscheinlich sei.
Der Landtag hatte am 1. März 2022 unter dem unmittelbaren Eindruck des russischen Angriffs auf die Ukraine mit breiter Mehrheit beschlossen, die Stiftung auflösen zu lassen. Ein im Auftrag der Landesregierung dazu erstelltes Gutachten sah dies als möglich an. Der von Ex-Ministerpräsident Erwin Sellering (SPD) geführte Vorstand weigerte sich jedoch unter Hinweis auf das Stiftungsrecht, den Beschluss umzusetzen und legte seinerseits ein Gegengutachten vor, das die Auflösung als rechtlich nicht durchsetzbar einstufte.
Nach Einschätzung Urbans lagen dem Gutachten, das die Auflösung der Stiftung für möglich hielt, Annahmen zugrunde, die sich nicht bestätigt hätten. Die Darstellung, dass es sich bei den Stiftungsmitteln von Nord Stream 2 um sogenanntes „Blutgeld“ handele, sei nicht haltbar, da das Geld nicht unmittelbar aus kriminellen Geschäften stamme und vor Beginn des Angriffskriegs geflossen sei, argumentierte der Stiftungsexperte.
Zudem seien mit der Auflösung des wirtschaftlichen Teils alle Kontakte der Stiftung zu Nord Stream gekappt worden und mit der Satzungsänderung sei der dem Gemeinwohl dienende Klima- und Umweltschutz nunmehr alleiniges Ziel der Stiftung. Für dessen Umsetzung habe die Stiftung auch ausreichend Geld.

The lawyer certified that Sellering's foundation board was acting in accordance with the law, but also explained that the state parliament's resolution to dissolve the company was not legally objectionable.
However, the dissolution of a foundation should always be viewed as a last resort and is not necessary in this case.
Urban suggested abolishing the political influence of the state government on the foundation, which previously determined the board, and putting the foundation entirely in private hands.
“The discussions are already making the foundation’s activities more difficult,” said the lawyer.

The MV Climate Protection Foundation was founded at the beginning of 2021 to enable the completion of the Nord Stream 2 natural gas pipeline while circumventing threats of sanctions from the USA against the companies involved.
The subsidiary of the Russian state-owned company Gazprom contributed 20 million euros to the foundation for environmental projects, and the country contributed 200,000 euros.
The foundation's business operations, which were temporarily set up to complete the construction of the gas pipeline and were also financed by Nord Stream 2, were wound up.
A special committee of the state parliament deals with the background and circumstances of the founding of the foundation and its impact.
After the report was published, foundation board member Sellering thanked State Parliament President Hesse for her initiative.
“With the representative Dr.
Urban managed to present an important proposal to objectify the conflict.
Now the state parliament can discuss how it will view the foundation in the future,” said Sellering.
According to CDU MP Sebastian Ehlers, the new report does not change his party's stance.
“The political will to dissolve the foundation remains for our group.
A lot of time was wasted due to the charade of Manuela Schwesig and her political foster father Erwin Sellering,” complained Ehlers.
The opposition politician was convinced that immediately after the start of the war two years ago there was a time window “in which the prime ministers could have thrown out the board and initiated the end of the foundation.”
He accused the red-red coalition of “delaying tactics for years.”
“Schwesig’s continued inaction has ensured the survival of the foundation,” said Ehlers.
FDP parliamentary group leader René Domke also criticized the fact that the delay had prevented the implementation of the state parliament's decision.
The FDP is not available for subsequent greenwashing of the foundation, as indicated.
“In the end, it remains to be seen that this foundation will remain a symbol of a failed secondary foreign policy of the Sellering and Schwesig governments.
The foundation will hang like a log on the Prime Minister's leg.
“It is a monument to an almost blind, Russia-loyal SPD policy in the country,” stated Domke.
He also expressed the assumption that “Gazprom and thus the Kremlin were able to exercise considerable influence over the structure of the foundation and that it will remain in perpetuity due to the legal nature of the foundation.”
