The Supreme Court of Justice of the Nation
declared a claim abstract and revoked a ruling
from a Labor appeals chamber, which
made the disaffiliation of the Santa Fe Truckers Union, led by Sergio Aladio, of the National Federation of Truckers
, final.
headed by Hugo and Pablo Moyano.
Aladio and the Moyano have
a long internal fight for control of that powerful section of Santa Fe.
In this framework, the highest court, with the signature of Horacio Rosatti, Carlos Rosenkrantz, Juan Carlos Maqueda and Ricardo Lorenzetti, indicated that the situation of the Union vis-à-vis the defendant Federation
“has changed substantially”
as a consequence of the disaffiliation that occurred, with the result which a statement on the discussion brought to the attention of the Court “would be unofficial.”

Notwithstanding this, the Supreme Court understood that "it is also appropriate
to revoke the appealed ruling of the Labor Chamber
, since its subsistence could cause an unjustified tax on the appellant,"

In this way, the disaffiliation of the provincial Union from the National Federation was finalized.
The case originated in the intervention ordered on April 24, 2014 by the National Federation of Truck Drivers and Workers in Automotive Freight Transport, Logistics and Services, regarding the Union of Truck Drivers, Workers and Employees of Automotive Freight Transport, Logistics and Services of Santa Fe.
The Santa Fe union appealed that intervention, but the measure was confirmed
on September 30, 2020 by Chamber I of the National Chamber of Labor Appeals.

Against this pronouncement, the local union filed
an extraordinary appeal,
the denial of which led to the presentation of a complaint before the Supreme Court of Justice of the Nation.
Among various arguments, the union stated that at its assembly
on May 21, 2016 it had decided to disaffiliate from the Federation.
While the file was being studied by the Court, the Union
added two presentations.
On the one hand, it reported the receipt of a document letter dated December 21, 2022, signed by the Secretary General of the Federation.
There he realizes that "in its XXXIII Extraordinary Congress on 11/15/2022 (...) it
had been unanimously resolved 'to accept the disaffiliation
of the Union of Truck Drivers, Workers and Freight Transport Employees of the Province of Santa Fe to the National Federation of Truckers'”.
On the other hand, he attached a copy of the provision DI-2023-1-APN-DNAS-MT, of January 9, 2023, issued by the National Directorate of Trade Union Associations of the Ministry of Labor, Employment and Social Security, which
had for disaffiliated from the Federation Union “since May 21, 2016.

The Court has said that its sentences must take into account the circumstances existing at the time of the decision, even if they supervene on the filing of the extraordinary appeal.
