According to the mayor, the city of Wolfratshausen's hands are tied due to a court decision: the furniture stores XXXLutz and Mömax must remain closed on Sundays when they are open for shopping.
Wolfratshausen - Renate Tilke (CSU), among others, reacted with great regret to the news at the most recent city council meeting: The furniture stores XXXLutz and Mömax must remain closed on shopping Sundays in the future.
The Bavarian Administrative Court has determined that “shopping on Sundays or public holidays must be limited to the spatial surroundings of the event,” explained town hall boss Klaus Heilinglechner (BVW).
The mayor speculated that the decision would “hurt” both companies.
But retailers in the city center also suffer.
Until now, XXXLutz and Mömax have been advertising nationally for the four annual markets in Loisachstadt, which are a prerequisite for shopping on Sundays.

The court’s decision was “very sad,” said Tilke.
The dealers in the city center would have benefited greatly from the furniture stores' print and radio advertising.
Tilke spoke of a “crazy influx”.

On instructions from the government of Upper Bavaria, the city council had to set the dates for the four traditional markets in the rafting town on Tuesday.
In this context, the municipality was warned to bring the shopping Sundays on the occasion of the Mid-Lenten market (March 10th), Nepomuk market (May 12th), Kirchweihmarkt (October 13th) and the Martini market (November 10th) into line with the shop closing law.
This says, among other things: “The additional shop opening times may only be a supplement to the market event and must be directly linked to the main event.”
It was a tightrope walk, now the ridge has been crossed.

The city market master Hubert Bernwieser brought the legal requirement down to a simple denominator: only business people in the immediate vicinity of the market are allowed to open their doors - not those in the periphery like the furniture store bosses on Hans-Urmiller-Ring.
In the past, says Heilinglechner, the city walked a tightrope, “now the tightrope has been crossed.”
The mayor emphasized that the municipality's hands were tied.
Due to the unambiguous instructions from the district government, the previous regulation must be abandoned and a new statute must be formally adopted.
The city councilors did this with a vote of 25-0.
According to the head of the town hall, both XXXLutz and Mömax as well as the Werbekreis Kaufstadt Wolfratshausen were informed about the change in the legal ordinance in advance of the meeting.

According to Heilinglechner, there is de jure a glimmer of hope for the two furniture stores - but in fact there is none: XXXLutz and Mömax would have the opportunity to set up a market in the commercial area themselves.
Such a concept must be submitted to the district office for approval.
The big catch: The space that has to be filled with merry-go-rounds and carousels on a shopping Sunday “has to be larger than the sales area of XXXLutz and Mömax,” said market master Bernwieser.
Mayor Heilinglechner made it concrete: “That would be more than 55,000 square meters.”
Although Bernwieser considers it a hopeless undertaking to set up such a huge market in the commercial area, Heilinglechner holds the door open for the furniture stores: "It's up to XXXLutz and Mömax." As long as a concept is developed and approved by the district authority, " “We can change our statutes again,” said the town hall boss.
From now on, the following applies: On Sundays when shops are open in Wolfratshausen, the lights of the furniture stores in the commercial area will remain off.
