How much the issue of tree protection regulations divides Herrsching's local council became clear once again at the meeting on Monday evening.

It was only after more than an hour of discussion that a solution was reached on how to proceed.

- After a break for discussion, Herrsching's local council reached a majority agreement on Monday on how the future construction, environment and infrastructure committee would proceed with the issue of tree protection.

The discussion had felt like it was going in circles for more than an hour.

It was about small things for some, essential things for others.

On the agenda was a change to the rules of procedure, which will assign nature and environmental protection, tree protection, green planning, heat planning and energy issues to the building committee in the future.

The local council only agreed on this in January with a vote of 19:3.

The topic of tree protection regulations causes emotions to run high in the local council with great regularity.

This time, BGH local councilor Claudia von Hirschfeld, among others, felt overrun in January.

“You have to admit that we deal with it afterwards, you don't have to shake your head.

“It’s gone wrong enough,” she said, recalling the council’s request, which had to be canceled at short notice.

Her parliamentary group colleague Christiane Gruber had previously initiated the discussion to leave final decisions on a tree protection ordinance not to the smaller committee, but to the entire local council.

This was preceded by a statement from the Pro Natur association, which referred to an administrative court ruling from 2020.

This is about the right to speak for non-members of a local council committee.

The community of citizens, four of whom are represented on the local council, shared concerns that this could shift the proportional representation.

The Herrschingen committees are staffed accordingly in this proportion, as in any other municipality, according to the Bavarian municipal code.

Accordingly, for each named committee member in Herrsching there are two named representatives who can step in and therefore have the right to speak if one is unable to attend.

With the exception of small factions such as the FDP, which only has two people sitting at the council table, no faction has so far been embarrassed by not being able to find a representative.

The citizens' community's concerns initially caused people to shake their heads - and their request to only allow the building committee to consult in advance in order to continue the discussion in the local council was met with incomprehension.

Wolfgang Schneider (SPD), among others, thought this was unnecessary, “then we can save ourselves the building committee,” he said.

Thomas Bader (CSU) agreed: “You can already see how long we need to bag this one point.” In order to avoid this, the committee should ultimately be entrusted with this in a smaller group.

Mayor Christian Schiller and managing director Guido Finster also pointed out that decisions can be transferred to the local council at any time - if a third of the committee members wish this or if a quarter of the local council requests a review.

Anke Rasmussen (Greens), who initially shared the same opinion as the BGH, was convinced that “the right of transfer is sufficient”.

However, only after Vice Mayor Christina Reich (CSU) requested a short break in consultation with a motion on the rules of procedure.

After more than an hour of discussion, the council majority then voted for the resolution prepared by the administration in accordance with the January meeting to adapt the rules of procedure to the new assignment of tasks for the decision-making construction, environment and infrastructure committee.
