The widow of Corporal Miguel Ángel Andújar, one of the two soldiers who died on December 21 during maneuvers in an artificial lake at the Army base in Cerro Muriano (Córdoba), has requested preventive detention for the three commanders under investigation in the accident, the captain - who was removed from his duties on the same day of the events -, the lieutenant and the company sergeant.
The military judge of the Togado Court Number 21 had placed the three soldiers under suspicion, who appealed their accusation to the Second Territorial Court of Seville, but this Monday the court rejected the appeal.
Now, the private prosecution argues that the court is the one that considers that the three committed a serious infraction, and this classification of the military code applies to whoever causes “serious damage to the means or resources of the Armed Forces or to people, or risk to the service or security of a force, unit or establishment of the Armed Forces.”
The petition states that there are “sufficient reasons” to order preventive detention due to “the seriousness of the facts” and to “avoid the loss or manipulation of evidence” to which the defendants who still maintain their jobs could access.
For his part, the legal representative of the other deceased soldier, Carlos León, also indicated at the beginning of the year that, if he were charged, they would also request preventive detention for the responsible commanders.
