Hamburg - Even if the consumption of cannabis is legal for adults in the future, that does not mean that working people can simply use the drug at work.
Because employees owe their unhindered work performance, explains Prof. Michael Fuhlrott, specialist lawyer for labor law from the Association of German Labor Lawyers (VdAA).
If this is no longer the case due to cannabis, labor law measures can follow.
Even if consumption is not officially prohibited in a company.
According to the lawyer, it is enough if someone is actually a lively person but suddenly appears calm and subdued after consuming cannabis in the office.
Cannabis legalization is a reason for operational regulation
However, the lawyer advises companies to use legalization as an opportunity to adopt official company regulations.
Cannabis consumption could be banned on the entire company premises.
At the same time, there is a duty of care, says Fuhlrott.
If someone is clearly under the influence of drugs, the employer must intervene and send employees home.
What about the joint after work?
What happens after work is up to each individual.
A joint lit while passing the factory gate is no longer any of the boss's business - as long as those affected return to work the next day in good shape and perform at their normal level.
Exception:
If a company reference can be made through work clothing, for example, a company can also prohibit this.
