From now on, municipalities will be more strictly bound to close building gaps and densify interior spaces in residential and commercial projects in the future - and not simply build on greenfield sites.

Erding - The Free State wants to curb land consumption through the state development program (LEP).

In return, the city and local councils are faced with another bureaucratic monster, which also limits their creative options and planning sovereignty.

The Erdinger city council is correspondingly disillusioned.

But all other municipalities will also be subject to the – attention to word monster – “requirement to examine the need for new settlement areas for residential and commercial purposes as part of the state planning review”.

Michael Backes from Urban Development now presented this to the city councilors in the Urban Development Committee.

According to him, the new regulation is an outcome of the new LEP, which sets guidelines for regional and municipal planning.

According to Backes, the previous regulation stipulated that internal development had to take place before external development.

Now we're talking about priority.

What is also new is that a deviation must be explicitly justified.

“There will have to be a needs assessment in the future,” explained Backes.

The number of inhabitants, development and forecast are taken into account, the average household size, the central location classification (Erding, for example, is a regional center), the transport connections, but also the expected economic development.

According to Backes, part two of the needs assessment includes the “existing area potential with intended use, the building areas included in the land use plan, the unplanned interior area, conversion areas, but also vacancies and potential for densification”.

Backes cited the need to develop an activation strategy, i.e. space and vacancy management, as a major challenge.

On this basis, a decision must then be made as to whether the green meadow can be dredged.

The problem unspoken at the meeting: Not all indoor areas are likely to be available.

Furthermore, Backes continues, the municipalities also have to take into account the follow-up costs of sealing and development, such as the social infrastructure with new kindergartens and schools.

The potential for conflict also includes the requirement that intermunicipal commercial areas be examined.

The point of contention here is usually how the trade tax is divided between the two communities involved.

But Backes also provided information about exceptions.

This is represented by an existing, current and justified land use plan. No detailed requirements planning is necessary if gaps in settlements are closed and the edges of towns are rounded off.

Nevertheless, Backes made it clear: “Considerable additional effort is to be expected in land-use planning.”

At this point, Mayor Max Gotz (CSU) intervened, saying that this was “a further contribution to bureaucratization”.

He gradually no longer believes that it can be turned back.

The planning offices are already in a “jungle of specifications”.

Stephan Treffler (ÖDP) said “that saving space is fundamentally right”.

However, Erding is one of the regions with increased population pressure and a corresponding need for housing.

“Such a reform is certainly difficult,” he said.

When asked, Gotz said that the conversion of the air base would also fall under the new regulations - and could curtail the city's planning.

Gerhard Ippisch (Greens) didn't think space, vacancy and activation management was that bad, "because it gives us a tool for urban development," he said.
