Work stopped for thirteen months.

But now the community can resume the renovation of the former stables in the Spielberg monastery.

The district office against which the lawsuit is directed says: "The Munich Administrative Court stated in its decision that the prospects of success of the lawsuit were now open and therefore a balance of interests was carried out in favor of the municipality of Oberschweinbach."

Neighbor sues against building project

As reported, a resident had filed a lawsuit against the conversion of the stables into a daytime café.

That was in March 2022, three months after the district office approved the construction project on December 8, 2021.

The commitment for the not insignificant subsidies had already been made.

Two million euros from the “Inside instead of Outside” funding pot had already been approved.

Around 400,000 euros should flow into the project from the municipal budget.

In March 2022, there was still no reason why the neighbor had filed a lawsuit.

This was only delivered in June.

Then it became clear: it was about noise.

A daytime café is to be built in the listed former stables with 48 seats inside and 30 seats on a terrace.

In addition, additional rooms are planned in the building that can be used as part of adult education.

45 helpers from all over the town arrived in April 2022 to help clear out the upper floor.

Rubbish, junk and hay had to go.

Urgent application leads to construction stop

When the lawsuit was received, the district office stated that the municipality could begin the renovation, but would do so at its own risk as long as the building permit decision - the subject of the said lawsuit - was not legally binding.

A new trial date has not yet been announced.

At the time, the possible completion date was autumn 2023.

But then came an urgent application from the plaintiff.

This resulted in a complete construction stop in December 2022.

At the time, however, the court did not criticize the project itself, but rather that too little attention had been paid to noise insulation.

Noise protection report gives the green light

This has now been made up for.

The 25-page noise protection report stated that there were no concerns about the daytime café from a sound perspective.

This was followed by the tecture, i.e. the change to the building application by the applicant, i.e. the municipality.

In this case: the building application for the conversion of the former stables into a daytime café, which was approved by the district office in December 2021 - supplemented by the noise protection report and other associated requirements, including those relating to parking spaces.

The tecture was approved.

And now that the construction freeze has been lifted by the court, architect Annette Primpke can get started again.

Now it's back to the tenders.
