Risk of flooding, unnecessary work, degradation of the landscape... In Oudon, along the Loire, the construction of an infrastructure supposed to perfect the operator's coverage in the sector is not favored by the town hall.

Future antennas are already giving rise to a disconnection lawsuit.

In Oudon, near Nantes, for several months a dispute has pitted the municipality against the operator Free, who wishes to install a relay station against its wishes on a green plot of land in the town.

The project involves the construction of a 33-meter pylon, carrying three antennas and within a concreted technical perimeter of 55 m², where a private meadow now extends.

An entire radiotelephony infrastructure against which the local mayor protests, who last year issued an order prohibiting the work.

The case was brought to the Nantes administrative court.

The community has lost.

But the mass has not yet been said.

In November 2023, justice ordered the municipality of Oudon to pay 1,200 euros to Free, and to grant the operator the desired building permit.

Nonsense for the mayor, Alain Bourgoin, who readily lists the reasons for not erecting an antenna there.

The councilor mentions pell-mell to our colleagues from

Ouest France

the risk of flooding of the plot, the degradation of the natural landscape or even the non-imperative nature of the work.

There is something else, too.

“This construction site is linked to the SNCF line which crosses the town

,” explains Alain Bourgoin to Le

Figaro

.

As the line is used by

the TGV which connects Nantes to Paris

, Free tries to place its antennas every 4 to 5 kilometers…”.

The digital comfort of passengers above all.

The Loire to the rescue

Some fifteen relay antenna projects carried out by different operators would have been refused in the sole territory of the community of communes of Pays d'Ancenis to which Oudon belongs, assures the local elected official.

And Free would be among the most tenacious developers.

According to the decision issued in November by the summary judge that

Le Figaro

was able to consult, the operator's lawyers considered that the municipal decree prohibiting the construction site represented an

“excess of power”.

The court also recognized the emergency condition of the work - contested by the municipality - on the grounds that the area concerned is in fact

"very partially covered",

and that the operator had made a commitment to of the State to extend the coverage of its mobile telephone network.

However, the town has not yet admitted defeat.

An unexpected environmental ace found itself at the bottom of its sleeve, with the classification in December of the large landscaped ensemble of the Verrou du Val de Loire.

This 1,400 hectare area, running along the river, from Cellier to Orée-d'Anjou, is now protected because of its remarkable picturesque character.

“The damage to the landscape that the construction of the station would cause allows us to counter-attack with, this time, the support of the State, represented by the DREAL

(regional directorate of the environment, planning and housing, Editor's note.)

"

, summarizes Alain Bourgoin.

“Rather confident”

, the councilor is now waiting for the file to return to the hands of the Nantes administrative court.

That is, by the middle of next year, at the latest.
