The legal dispute between SC Fürstenfeldbruck and the city of Fürstenfeldbruck is approaching its climax.

Two proceedings concern the future of the football club.

In total, around 40,000 euros are being disputed.

Fürstenfeldbruck – This Friday, the representatives of SC Fürstenfeldbruck and the city will face each other for the first time in front of Regional Court II in Munich.

A claim for damages of 26,600 euros from the SCF against the city is being negotiated.

The background: The city council rejected the football club's request to sublet the stadium on Klosterstrasse to the homeless regional league team Türkgücü Munich for seven to ten games.

The rejection is unlawful, says the SCF and is claiming lost profits from eight games.

Foreclosure is imminent

But that's not the only process going on between the city and the club - lawsuits are also being filed in the other direction.

The city of Fürstenfeldbruck has initiated an enforcement order for almost 13,000 euros against SC Fürstenfeldbruck.

According to a press spokeswoman for the Munich Regional Court, the sum consists of outstanding payments in the areas of “operating cost participation” in the years 2019 (3275.11 euros), 2020 (1959.82 euros), 2021 (2302.54 euros) and 2022 ( 3316.15 euros) as well as “usage fee” (1000 euros) and “building yard invoice” (665.50 euros).

In total it's over 12,500 euros.

The club lodges an objection

The sports club has lodged an objection against the decision.

The proceedings were therefore transferred from the dunning court originally responsible to the Munich regional court.

But there they were still waiting for the city to substantiate its claim.

“However, this is not yet available,” said the court spokeswoman on Monday evening.

City can have SCF seized

According to SCF President Jakob Ettner, these two procedures decide whether the club continues to exist.

If you lose both, SC Fürstenfeldbruck could face bankruptcy.

The situation is precarious.

“The city has been able to have us seized since December,” says Ettner.

And now, of all times, when the club is well on the way to getting a team fit to play again after it had to be withdrawn from playing last summer due to numerous departures.

Ettner emphasizes that he considers the demands to be unlawful: “It is scandalous what the city is trying to foist on the club.” The city itself is keeping a low profile and only confirms the existence of the two procedures.

Regarding compulsory enforcement, a press spokeswoman explains: “The proceedings will show whether the enforcement order is justified or not.”

Future use of the sports grounds

According to Ettner, the holding of the general meeting, which has been pending for a long time, also depends on the outcome of the proceedings.

After all, a potential new board member must know what he is getting into.

And something else depends on the procedures, explains the SCF President.

According to Ettner, the usage agreement for the area on Klosterstrasse is regulated in such a way that the city can terminate it if payments are outstanding.

The SCF president believes that this should pave the way for the complete takeover of the site by TuS Fürstenfeldbruck - in particular by the American football department Fursty Razorbacks.

Mayor disagrees

Both Mayor Christian Götz (BBV) and sports officer Martin Kellerer (CSU) recently vehemently contradicted this theory in the Tagblatt.

The only thing under discussion is a joint use of the area by both clubs.

The decision will be made on March 21st at the meeting of the Committee for Integration, Social Affairs, Youth and Sport.

In the city council

The SCF was also a topic at this week's city council meeting in the large meeting room of the town hall.

Dirk Zahn spoke during the citizens' question time.

He has been with the SCF for a year and is responsible for building the first and second men's teams.

“The project is taking shape,” he announced from the audience.

A first and a second team would be available for the new season.

It is therefore difficult to understand that obstacles are continually being placed in the way of the SCF.

“Why are the Razorbacks assured that they will get the SCF sports grounds even though the SCF is at full capacity with its youth players?” he asked to Mayor Christian Götz.

First of all, the club should be congratulated that there is a first and second team again, replied the town hall boss.

“We are very happy about that.” He emphasized that the Fursty Razorbacks were not guaranteed anything.

There are one or alternative proposed resolutions that will be discussed in the next Committee for Integration, Social Affairs, Youth and Sport.

Zahn continued to probe: Why couldn't the Fursty Razorbacks stay at TSV West if they already train there?

That cannot be answered quickly, said Götz.

“Many people are thinking about how we can optimally occupy and utilize our sports facilities in Bruck.”

Finally, Dirk Zahn wanted to know why the mayor was resisting an appointment alone with the SCF board.

Götz replied that it was unusual and up to him as mayor and head of administration to decide which employees he should bring in on which dates.

It makes no sense to exchange ideas without employees from the areas of law, real estate and sports promotion.

“A chat where I listen to something is not productive.” For detailed answers, Zahn should put his questions in writing, the town hall boss concluded.
