ordered with respect to the former chief of staff of Axel Kicillof and mayor of Lomas de Zamora Martín Insaurralde, his girlfriend Sofía Clérici and his ex-wife Jessica Wanda Judith Cirio.
The case
investigates alleged acts of illicit enrichment
of a public official and money laundering, committed, among others, by the former mayor of Lomas de Zamora, which came to light after photos of his yacht trip to the coasts of Marbella. , Spain.
Room IV of the Federal Chamber of Criminal Cassation, made up of doctors Gustavo Hornos, Mariano Hernán Borinsky and Javier Carbajo,
declared inadmissible
the appeal filed by the defense of Jessica Wanda Judith Cirio against the decision of Chamber III of the Federal Court of Appeals of La Plata.
This had ordered the general inhibition of assets of the named person along with Martín Insaurralde and Sofía Clérici, in the proceedings where the alleged crimes of illicit enrichment of a public official and money laundering committed by those named are being investigated.
The unanimous decision of the country's Highest Criminal Court highlighted that the provisions established by the United Nations Convention against Corruption, the Inter-American Convention against Corruption
and the Public Ethics Law (law 25,188) must be applied
in the case , along with
the recommendations and protocols proposed by international organizations against money laundering, of which Argentina is a part, such as the FATF (International Financial Action Task Force) and the GAFILAT (Latin American Financial Action Task Force).
Furthermore, it was pointed out that the resolution adopted, due to its nature and effects, is not a definitive sentence or equivalent to such, while the appellant did not prove an addressable federal issue either.
The proceedings will continue to be processed before the Federal Court No. 2 of Lomas de Zamora, which is being subrogated by the Federal Judge of La Plata, Ernesto Kreplak
