Contrary to Bad Tölz's stated wishes, the district authority has approved asylum accommodation for almost 100 people on Isarleitenweg.

Although the Tölzer city council rejected the project in 2023.

Bad Tölz – The city recently decided unanimously to take legal action against the approval of the higher authority.

The bad thing about it: The lawsuit has no suspensive effect.

Initial clearing work has already taken place on the property in question.

Several communities in the district are suing against the state-imposed accommodation of asylum seekers: including Dietramszell and Greiling.

But the current situation in Tölz cannot be compared with Greiling's verdict, which caused a national sensation (we reported).

Tölz construction experts don’t want a “block for 96 people” in a residential area

In the district town, it is the two private owners of the property on Isarleitenweg who want to make their area available to the district.

To this end, they submitted a building application, which was discussed in the city council's building committee in September 2023 and rejected.

Among other things, the city's construction experts found the development with a "block for 96 people" to be far too dense, and there were not enough parking spaces for cars and bicycles.

Together with many other arguments, the project in a “residential area” was ultimately rejected, with the decision ultimately resting with the district office.

This has now replaced “the community agreement of the city of Bad Tölz”, as it is said in official German.

Normally the district building authority has no opportunity to override a change ban.

However, it is based on what Mayor Ingo Mehner (CSU) said at the city council's most recent building committee meeting: "ominous paragraph 246, paragraph 14".

In the event of an exceptional situation, this gives extensive opportunities to override the municipalities' right to self-government.

With the approval that has already been given for the construction of accommodation for 96 people on the property on Isarleitenweg and an operating period of twelve years, the city believes its rights have been violated and has therefore instructed its lawyer and filed a lawsuit.

In the city's opinion, the requirements of Emergency Paragraph 246 are not met for the specific project.

The city is now leveraging the fact that it has accommodated almost twice as many asylum seekers and refugees as it would have to according to the so-called Königstein key.

A discretionary decision by the authority, Mehner wrote in a press release, “requires that the people must be distributed evenly across the district.

That's not happening at the moment." But in addition to the demand for equal treatment of all municipalities - "because only everyone can do this together" - Mehner and the building authority point out that the district itself also still has free areas.

At the building committee meeting in February, the town hall leadership received clear support from the city councilors: Karsten Bauer (CSU) felt it was a shame that “we are simply being ignored” and criticized the huge block that was being built in the residential area.

Johannes Gundermann (Greens) wanted to know exactly: “30 people already live in the house and 96 will be added?” That’s how it is, confirmed building authority manager Christian Fürstberger.

“No matter what the court decides, we have to sue,” said Christof Botzenhart (CSU), formulating his position.

“We owe that to the residents there.

We must take every possible means to prevent this shared accommodation.” Mehner did not give details of how the lawsuit should be justified “for tactical reasons”.

Planned refugee accommodation in Lenggries and Münsing

The city itself is the immediate neighbor of the area in question and is of the opinion that the general residential area is characterized by one- and two-family homes as well as semi-detached houses.

As before, living is possible there, and accommodation businesses or small craft businesses can also be permitted, but none that would result in heavy traffic.

Other, particularly noisy uses should be excluded by the 2023 development plan.

A building permit was most recently granted for the container accommodation on Scharfreiterstrasse in Lenggries.

Construction is underway there.

Around 100 places are to be created.

Accommodation at Münsinger Schlichtfeld with 94 places is also approved.

According to the district office, a lawsuit is pending here.

Against the declared will of the city, the district office also approved the change of use for the former “Lindenhof” on Königsdorfer Straße.

The city is opposed to the official change of use - also in view of the fact that the quota is significantly exceeded.

56 places can be occupied there.

Opinion of a resident on Tölzer Isarleitenweg: “100 more people is just too much”

Max Hildenbrand is one of the house owners on Isarleitenweg.

His 90-year-old mother is a direct neighbor of the planned asylum accommodation for almost 100 people.

Together with other residents, he points out that up to 60 people have been accepted in the semi-detached houses Nos. 10 and 12 on Isarleitenweg without complaint.

“But another 100 people is simply too many, especially since the city has already exceeded the quota,” said the veterinarian.

Therefore, other solutions have to be found, especially since the district itself still has land available.

Hildenbrand particularly criticizes the fact that District Administrator Josef Niedermaier (FW) “is not offering the slightest resistance”.

There is no infrastructure for the additional 96 people who will live there in the future; access is via a narrow street.

Hildenbrand, who is also taking legal action against the construction of the accommodation, calls for “an active policy” that solves the problem.

There is no end in sight here, because new refugees are constantly being distributed to the districts.

That's why there are already several lawsuits from the communities.

According to Hildenbrand, there can be no question of “integration of the refugees” with such an approach.

Above all, he criticizes the fact that the affected residents were not informed in any way about the building permit and that the district office did not respond to inquiries.

“District Administrator Josef Niedermaier was elected by the population and is therefore obliged to stand up for the interests of the citizens,” is the opinion of the Tölz native.
