The Munich II Regional Court will probably not agree with SC Fürstenfeldbruck in a legal dispute against the city.
Fürstenfeldbruck/Munich – At least that’s what the presiding judge said on Friday with regard to an upcoming verdict.
As reported, it is about a loss of earnings of 26,000 euros due to the ban on subletting to Türk Gücu two years ago.
But there is much more hidden behind the dispute.
The president of the football club was seething with anger and frustration.
He repeatedly interrupted the judge and shouted around the courtroom.
There was no mistaking the fact that he felt betrayed and left out by the city.
The judge understood his irritation.
But in civil law only the matter being sued for can be dealt with.
And so the judge was more than anxious to limit the SCF boss's heated monologue to the facts.
Subletting
Accordingly, the Bruck Kickers had tried to supplement the club's coffers by subletting their stadium to the regional league team Türk Gücü with 26,000 euros.
The club could have used the money to build a men's team and its excellent youth work.
The club asked the city and was turned down.
The security concept with fire protection, breakwaters and escape routes was unacceptable.
Improved
But at this point opinions differed because, from the president's point of view, this concept had been improved several times.
At some point it was probably too late to sublet.
The SCF boss considered the reasons to be pretextual.
Allegedly, the end of Türkgücü as a subtenant was decided in a secret city council meeting.
Because the encounters are so-called security risk games because of the problem fans, a two-meter-high fence in the interior, a higher and closed barrier, emergency access and lounges for the police were required.
But because in the end there was no fire concept, the city of Fürstenfeldbruck waved it away.
Audio recording
From the SCF boss's point of view, the city had not required comparable requirements for years, let alone a fire concept.
He had an audio recording of the city council meeting in which the decision against SC Fürstenfeldbruck was allegedly made.
But the presiding judge had no desire to listen to the recording because it was not at all important to the lawsuit itself.
“Even if the motives were perhaps not louder and even if the city was perhaps asleep, it would have done a damn thing and approved this security concept,” the judge tried to explain the problem to the plaintiff.
He had a hard time swallowing the legal details and kept protesting.
Finally, both sides were given a deadline for further written submissions.
A decision on how to proceed with the dispute is expected to be made at the beginning of April.
That was the preliminary report for the trial.
