DNA convicts beating burglar

While the Romanian had denied the burglary in Dachau to the police, he admitted both crimes in the sixth criminal chamber - and received suspended sentences of ten months and one and a half years respectively.

The verdict was guilty of theft as well as theft and bodily harm.

The chamber had therefore fully followed the request of defense attorney Jürgen Neumaier.

The public prosecutor's office had requested ten months and two and a half years, each without probation.

The offenses were therefore tried separately because a separation was necessary due to an old sentence that led to a subsequent combined sentence with Dachau.

The crime in Erding was more serious, not only because of the serious injury to the employee, but also because of the loot and the property damage caused.

It consisted of a silver coin worth 150 euros and a 400 euro wristwatch that he had stolen from parcels that were stored in the kiosk.

The two men initially struggled with each other.

The Romanian then grabbed a chair and approached the injured party with it in a threatening manner.

After he armed himself with a bottle to defend himself, he initially backed away.

When the employee put the bottle back on the shelf, believing that the attack was over, the defendant struck him with the chair.

However, the injured party corrected the accusation in court that his nose was not broken.

It was just a crack;

the pain was limited.

After it could not even be proven by the video from a surveillance camera that the defendant had struck to secure his loot, the public prosecutor's office only assumed theft and bodily harm.

In Dachau he also broke a window to get into the shop, which he then trashed, but only looted a piggy bank.

Witnesses reported that the man was obviously drunk.
