It remains to be seen whether Berlin's federal policy or Brussels' European policy will strike in Ellmau.

Since the most recent meeting of the Rottach local planning committee it has been clear: dairy and district alpine farmer Anton Maier is finally allowed to build his dairy cattle stable in the historic hamlet.

It took three years.

Rottach-Egern

- Since 2021, since the two farming families Maier and Bachmair living in Ellmau applied for a modern dairy cattle stable or a riding arena with horse boxes to secure the future of their agricultural companies, the Rottach-Egern local council and the building authority have been concerned with the further development of the town of Ellmau.

Even district architect Christian Boiger was already involved, as it is an idyllic, original hamlet in the outer area, characterized by historic farms.

It's about the compatibility of the new buildings with the beautiful existing buildings.

The Bachmair horse breeding families already had the green light in November 2022.

Playpen approved

And now also for district alpine farmer Anton Maier: He has now been approved for a large, closed structure measuring 36 by 24.4 meters without an extension (originally 40.9 by 19.9 with an extension) and a reduced height of 4.46 meters as a playpen.

It will be built in the direction of Valepper Straße, but well hidden behind an old hag.

“The building is conveniently located and designed.

"The privilege was given by the agricultural office," said building authority manager Tanja Butz and recommended approval including a deviation for the skylights: They are now common practice in dairy cattle stables because they are important for ventilation.

Also for building protection, as Martin Strohschneider (CSU) noted.

Daughters want to continue the business

The fact that Anton Maier, who has previously run a classic dairy farm including alpine pasture management and horse-drawn carriage rides as a side business, has even approached the topic of a playpen with its immense costs is primarily due to his daughters.

They have agreed to continue the well-functioning combination farming operation with cattle turning, first to the Niederleger and later to the Hochleger Siblialm.

Accordingly, they also decided on relevant vocational training.

“Playpen is also beneficial to human well-being”

But not just to secure the company's future, the Maiers are trying to adapt the upcoming legislation, which primarily focuses on animal welfare.

Anton Maier also sees the advantages: “A new, modern playpen is also beneficial to human well-being.” Modern technology brings optimized processes and makes work easier.

In addition, the new stable for the cows, the young cattle and the calf boxes in the old stable would give him enough space for the steeds of his carriage driving business.

In the future he could also devote himself again to breeding foals, for which there was a lack of space for years.

Mayor Christian Köck (CSU), however, regretted that the small-scale agriculture here, with its combination farming that is beneficial to animal welfare, also had to bow to the new laws.

Since the current status is: Year-round tethering should be banned from the end of 2028.

But combined farming, as the Maiers operate and want to continue to do so in the spirit of animal welfare, should only be permitted until the business is transferred to the next generation.

There is still no regulation for the continuation of combined farming

In the same breath, Köck praised the farmers who, like the Maiers in Ellmau, are embracing the development: “We used to have 30 farms in Rottach-Egern.

Now there are only 15 left,” said Köck sadly, because these businesses would be the guarantee that Rottach could define itself as a holiday destination in a green and healthy landscape.

Thomas Tomaschek from the Greens then made it clear that his group, the Green MP Karl Bär from Holzkirchen and also Federal Agriculture Minister Cem Özedmir were in favor of combined farming: “It will then be Europe, not our federal government, that should actually be banned.” At the moment it is still the case: Even if Özdemir wants to go in the direction of a “Bavarian special path”, there is still no binding regulation for combined farming.

This is still an open legislative process in Berlin.
