The case for alleged
fraudulent administration
against former president Alberto Fernández is ongoing.
Federal prosecutor Ramiro González charged him along with the former head of Nación Seguros,

more crimes will be attributed to him,
as a result of the suspicious involvement in the Anses with the contracting of insurance for retirees who took out loans and the million-dollar commissions that They were paid to nearby intermediaries.
The maneuver under investigation began at the end of 2021, when President Alberto Fernández ordered that
all state insurance had to go through Nación Seguros
, which, in turn,
“hired a broker and private companies
,” the complaint maintains. the lawyer Silvina Martínez who originated the file.
The plot of opaque contracts with the insurance sector - in which Alberto Fernández began his political activity - was revealed by

A structure that operated within the ANSES and that moved close to
20,000 million pesos annually and 300 million in monthly
insurance commissions was stripped bare.
The 20,000 million pesos, stated in the complaint, is what "Anses pays the Nation per year to insure the lives of retirees and pensioners to whom it gives loans: since 2011 it has been granting them without this insurance."
In turn, Nación subcontracted other insurers and, as a bridge between the two state agencies, justice is now putting the magnifying glass on a broker, who would have received
a commission three times higher than the market: 17%:
about 300 million pesos per month .
With the investigation underway, Judge Ercolini ordered a series of evidentiary measures, which were promoted by the prosecutor in the case.
The signed letter requests the Head of the Cabinet of Ministers of the Nation and the Legal and Technical Secretariat of the Presidency of the Nation "to provide the background, actions and legal opinions related to the issuance of Decree No. 823/2021", with which Fernández imposed the services of Nación Seguros.
It was also required to send
all agreements or contracts
made from the different departments of the National State that signed insurance contracts and that were governed by the regulations that enable the figure of intermediaries.
Judge Ercolini also asked the AGN to send a copy of all the audit reports related to the provisions of Decree No. 823/2021, referring to insurance contracts by the National State and the jurisdictions with the signature. "NACIÓN SEGUROS SA" "and/or any subcontracting, coinsurance or reinsurance with other companies in the sector."
Also, SIGEN was asked to send a copy of all the audit reports regarding insurance contracts by the National State and the jurisdictions and entities with the signature "NACIÓN SEGUROS SA" and/or any subcontracting, coinsurance or reinsurance with other companies in the sector.
On the other hand, the court asked the Legal and Technical Secretariat and the National Insurance Superintendency to "provide relevant data in this regard" to reveal

A presentation order was issued to Seguros Nación, which was told to send all contracts or agreements signed with public entities based on Decree 823/202, as well as the administrative actions of the contracting entities of the policies that are linked to the appointments of insurance advisory producers (direct or organizers) within the framework of such contracts.
The suspicious circuit
Justice seeks to clarify the role as intermediaries of Pablo Torres García and Héctor Martínez Sosa,
married to a secretary of Alberto Fernández, María Cantero.
Part of the investigation and testing measures promoted by Ercolini also seek to determine whether this scheme was replicated in the Ministry of Security during the presidency of Alberto Fernandez.
How did it work in this case?
In the agreements that the Ministry signed with Nación Seguros there was a clause that allowed the alleged negotiation that is being investigated: “the contracting of the insurance that is the subject of this Agreement will be made between the Ministry and Nación Seguros – Central House, Sales Management Channel Public Organizations - admitting that the Ministry
may generate a designation of an intermediary if it considers it convenient for its interests
,” the regulations state.
During the four years that Alberto Fernández served as president, Nación Seguros was run by lawyer
Alberto Pagliano
, a friend from Fernández's youth who accompanied him when he started, in the 90s, in that field but on the side of the State.
This link and
possible influence peddling
is under analysis by the federal justice system.
The national deputies of the Civic Coalition Juan Manuel López and Paula Oliveto, who also denounced the maneuver, assured that as of this regulation
a monopoly was consolidated in the state insurance sector
that would have facilitated the intervention of private reinsureds and “brokers” in “not very transparent” operations.
