The former president will also be investigated based on the complaint from the Ministry of Human Capital. The prosecutor's office also charged Alberto Pagliano, former head of Nación Seguros, the director of Operations of the Anses Guarantee Fund, Federico DAngelo, and the brokers involved in the case.

This Tuesday, Alberto Fernández

added a new accusation

as a result of the complaint filed by the Minister of Human Capital, Sandra Petovello, for the

scandal linked to the suspected negotiations at Anses with the contracting of insurance

and the millionaire commissions that were paid to nearby intermediaries. to the former president.

In the opinion accessed by

Clarín

, federal prosecutor Ramiro González maintained that given "the state of the present process" he resolved to

charge Federico D'Angelo

, former General Director of Operations of the ANSES Sustainability Guarantee Fund). ,

Alberto Fernández

(former President of the Nation),

Alberto Pagliano

(former head of Nación Seguros), the head of San Ignacio, society of insurance advisory producers SA and the head of TG Broker SA.

The complaint was filed for the crime of

illicit association and defrauding the State.

According to the opinion of the prosecutor who considered that there are sufficient elements to initiate the criminal investigation, it is clear that in view of the maneuver revealed by

Clarín

there would be "

detriment to the National State due to commissions, intermediation costs

in insurance policies contracted with Nación Seguros SA within the framework of the 'ANSES Credits' operation (Sustainability Guarantee Fund).”

The current Government indicated that ANSES contracted "insurance coverage with Nación Seguros using

unjustified intermediaries

and paying commissions to the detriment of the public treasury."

The appointment of brokers

The national government reported that on May 22, 2023, D'Angelo Campos - former General Director of Operations of the Sustainability Guarantee Fund (ANSES) - decided to "designate San Ignacio Sociedad de Productos Asesores de Seguros SA as organizer and TG Broker SA as an insurance advisory producer, to intervene in the aforementioned insurance contracts 'Collective life insurance with debit balance' of the Sustainability Guarantee Fund)”.

The Executive Branch indicated that this was carried out without the justification of the decision being included in any administrative file and it was not carried out through the document management system that the ANSES requires to use.

What Sandra Pettovello asked to investigate is the fact that the defendants, alleging an alleged "lack of cost" for the State, "arbitrarily and without prior bidding or compulsivity between companies in the industry used companies to profit from the contracts of Nación Seguros SA" .

Among the irregularities exposed by the Executive Branch, it was maintained that in the first coverage policy for these risks issued, Nación Seguros appears assuming the risk together with other private insurers (coinsurance), of "dissimilar economic/financial capacity."

The policies duly sent to the ANSES, the complaint maintains, did not

obtain any review by the competent area,

regarding the participation of the included insurers or their percentage of participation.

Precisely,

the percentages for commissions

that insurers obtained is another of the items under investigation.

The Minister of Human Capital highlighted in the complaint that “every time the organization granted a loan to a retiree or beneficiary of any of the aforementioned social plans, it had to take out life insurance for that person and could only do so through this state company.”

The reported maneuvers refer to "a universe of pure premium paid by ANSES to Nación Seguros between March 2022 and October 2023 that amounts to

almost 10,000 million

nominal pesos. This information arose from a technical report of the new ANSES management , from which it was resolved not to renew the operation duly approved by the aforementioned Inter-administrative Agreement.”

Test Measurements

Among the measures of evidence requested by prosecutor Ramiro González is a request for a

testimonial statement from the now former head of ANSES Osvaldo Giordano,

"so that he can say everything he knew about the facts investigated."

Under this same line, an expert opinion was required in order to "

determine the property damage

, consisting of the variable between the regime prior to decree 823/2021 and the contracting operation through a reported insurance broker."

Regarding the brokers, the representative of the Public Prosecutor's Office asked the State registry of providers to report

whether San Ignacio Sociedad de Productos Asesores de Seguros and TG Broker are registered.

Once this information was obtained, it was requested that the corresponding public records be verified if both intermediaries "are duly registered and the date thereof; as well as the change of name or any variant."
