Fischbachau wants to go up, Irschenberg wants to go down.

One thing is clear: from the district office's point of view, a one-way regulation is not permitted - regardless of which direction.

– The communities of Fischbachau and Irschenberg have not come to an agreement on the question of whether the Deininger Berg should be closed from top to bottom or the other way around (we reported).

But now it is clear: Apparently a blockage in neither direction is even possible.

The district office informed our newspaper of this at the request of our newspaper and explained that the risk situation beyond the general risk in road traffic has not currently been sufficiently proven.

From this it follows: “In our opinion, a closure of the road, regardless of the form, is not necessary given the current situation and is therefore not permissible in view of the provisions of the road traffic regulations.” This means that the debate takes a surprising turn - after all, there has been the only agreement so far of the municipalities that a one-way system would be necessary and sensible.

But the Lower Road Traffic Authority sees it differently.

While the Fischbachau local council was talking about an “exorbitant increase in traffic” and the Irschenberg local council also welcomed a one-way regulation, the district office writes: “There is no reliable information about the actual load, traffic flows, speed level and significance.” The authority suggests this to carry out a traffic statistics survey over a meaningful period of time that provides information about this.

Four out of five accidents involve only one

From the perspective of the district authority, the accident situation is not unusual - in fact, the level of danger is rather low, writes the district office.

There were five traffic accidents on the community road between January 2020 and the end of February 2023.

The only person who was slightly injured fell alone on his motorcycle downhill on the wet road.

The other accidents include a wild animal accident and a car that rolled away after the driver got out.

Another car was damaged while reversing.

“Only in one traffic accident did two vehicles collide head-on,” the district office said.

The cause here was the inappropriate speed.

The core of the debate: the direction of travel on the red line.

Even if the time savings are small, many drivers apparently use the Deininger Berg as a shortcut.

However, there is no official data on this.

According to the district authority, the section up to the hamlet of Deining is 3.5 meters wide at the narrowest points - and therefore narrower than the standard cross-section of five to six meters.

Traffic tends to be in one lane, but there are alternatives.

The speed was limited to 30 km/h and the weight to 2.5 tons (we reported).

From the authority's point of view, these restrictions are "suitable and appropriate to reduce the risks to the currently low level".

Before a closure, the strongest means would be to consider width restrictions and an even lower speed.

A closure in one direction must also be monitored.

The district authority shares the concern that many drivers could ignore the signs in favor of saving little time.

Can water protection also be achieved using protective barriers?

According to Irschenberg's mayor Klaus Meixner, the idea was originally suggested by the city of Miesbach, which feared that accidents would contaminate the drinking water protection zone (we reported).

The district office argues that a lot can be achieved in terms of water protection with guardrails and a road slope towards the mountain as part of the already planned renovation.

There has so far been no reaction from the town halls to the legal assessment.

Fischbachau's mayor Stefan Deingruber explained at the most recent local council meeting: "I promise that something will happen by the summer break - either from Irschenberg or from us." Previously, at the end of the meeting, several residents had pushed for a quick solution.

They reported aggressive drivers, a garden fence being hit and coaches driving on the road regardless of the weight limit.

The local council had already voted for the one-way regulation from bottom to top in August 2023.

When asked, Irschenberg's building authority and manager Michael Fellner only confirmed that there had been discussions between the mayors.

The local council will probably deal with the issue again.

Irschenberg had previously advocated a majority for a top-down solution.
