From the tunnel in Khan Yunis to the Shin Bet facility: investigation of a Nokhava/Shib terrorist

The military forces maneuvering in the Gaza Strip last week arrested additional Hamas terrorists who took part in the organization's terrorist attack on October 7, and handed them over for investigation by security officials - this is what Wala learned!

from officials in the Southern Command.

One of the arrested terrorists entered the territory of Kibbutz Kfar Gaza on the day of the massacre and managed to escape back to the Strip.

According to military sources, Israel currently holds a total of 230 Hamas terrorists who are suspected of taking part in the massacre on October 7.

Among them, 50 terrorists who have completed the initial investigation, are defined by the security establishment as "participants in the massacre" and will be transferred to a criminal investigation before filing an indictment, 140 terrorists who are still under internal investigation by the security establishment and the rest are in various stages of tests prior to the investigation.

Among these detainees, it turns out, there are about 200 terrorists who are defined as IDF (illegal combatants) whose detention has already been extended twice after two months of detention. An illegal combatant that gives him a different status.

These undergo an administrative hearing for purposes of arrest and further investigation.

Qualified military officials said that already on October 11, an emergency hearing was held under the chairmanship of the Legal Advisor to the Government with senior members of the judiciary and senior military officials who dealt with the legal proceedings against the militiamen who took part in the massacre on October 7. In the hearing, some of the participants defined the treatment of these terrorists as " The Eichmann trial of our generation," they also claimed there that "this is an event that goes far beyond a one-off criminal trial.

It's not a killer.

These are terrorists who committed an act beyond murder."

The discussion ended without a decision and since then a decision has not yet been made on the manner of legal treatment: whether they will be prosecuted under individual indictments or consolidated indictments under the law of complicity. Also, the question arose of who would be assigned the task, the judicial system military or civilian.

The military is part of the investigation process because it has weight in establishing the conviction against the terrorists/Flash 90, Chaim Goldberg

In the background, criticism is already piling up within the security system alleging that the military system is dragging its feet and unprepared in terms of personnel, logistics, and dealing with the bureaucracy for a scenario in which the task will be assigned to the IDF with the support of the State Attorney's Office. It is important to note that the State Attorney's Office contacted the Ministry of Finance regarding a budget for this issue, but as stated , the IDF is still not preparing for a scenario that will require hundreds of officials and the establishment of appropriate tribunals if necessary.

According to military sources, the dilemma still exists because of political complexities - among them, the hostage deal.

At this stage, the criminal investigation is being conducted by the Israel Police with the support of the State Attorney's Office and the assistance of the IDF.

The military is part of the investigation process because it has significant weight in the ability to establish a conviction against those terrorists. A very significant part of the evidence against them is found in the terrorists' head cameras, in the testimonies of soldiers, and in the materials seized during the maneuver - tens of thousands of media and digital files, and hundreds of testimonies given in recent months.

IDF spokesman: "The judicial system and the military prosecutor's office are mobilized for the task of bringing the terrorists to justice"/Flash 90, Haim Goldberg

The IDF spokesperson responded to the words: "The incidents are being investigated with the close cooperation of all security agencies, including the IDF. The handling of the incidents is led by the State Attorney's Office, with the cooperation of all security agencies and under the supervision of the Legal Advisor to the Government. The IDF agencies assist the police in all that is required, in particular in all related to the transfer of evidence against the terrorists found in the IDF units. As emphasized, the Israeli justice system as a whole, and the military prosecutor's office within it, is mobilized for the national task of bringing the terrorists to justice."

An official and qualified military official added that "so far, the military prosecutor's office has dealt with the issuance of thousands of temporary detention orders according to the Law on the Detention of Illegal Combatants, while thousands of temporary detention orders and hundreds of permanent detention orders have been issued. In addition, the military prosecution has dealt with hundreds of administrative and criminal detainees in the Judea and Samaria region who were arrested at the outbreak of the war on suspicion of committing various kinds of security offenses (incitement, illegal activities, involvement in prohibited organization, etc.).
