On a nursery site on Carl-Wery-Straße, trees were cut due to wind breakage.
A citizens' initiative speaks of an "act of destruction".
Clearing on the site of a garden center directly on the city limits of Neubiberg has led to major protests from the local citizens' initiative.
Their spokesman alleges reckless environmental outrage and demands compensation for the damage caused.
Apparently everything happened completely legally.
The area is not subject to the tree protection regulations
“This act of destruction not only spoiled the landscape, but also caused serious damage to the environment and the climate,” complains Oliver Hellmund, spokesman for the Citizens' Initiative for Neubiberg (BI-N).
People were “shocked and horrified by the felling of at least 70 trees” on the nursery grounds on Carl-Wery-Straße in Neuperlach.
In the photos you can actually see some tree stumps, but above all a lot of bushes that have been cut out quite radically.
However, the gardening business did not need a permit for the clearing because its areas are outside and therefore outside of tree protection or other nature conservation regulations.
In addition, the exception rule would also have applied to gardening.
Arborist Rüdiger Tresselt explains the background to the campaign on behalf of the owner.
“In the aftermath of the recent storms, the railway checked the S-Bahn tracks along the east side of the property and complained about some wind breakage.” Similar complaints came from Telekom, which was worried about its lines due to dead treetops.
In addition, in the fall, the city confirmed the “need of care” of the trees and “several half-dead trees” on the southern property boundary and energetically pointed out to the owner his duty to ensure traffic safety with regard to the adjacent footpath and cycle path.
Everything together led to the order for the corresponding clearing.
City wants to check fellings again
The city's nature conservation authority is now checking again whether a few more trees were felled than necessary.
She also wants to clarify whether there need to be measures for restoration, compensation or replacement.
The owner of the nursery applied to expand his business and build a solar park in 2023.
The Perlach district committee rejected this.
According to the planning department, the city has not yet granted any approval.
Hellmund's protest is also about sound insulation.
The Munich municipal utility company would now have to adapt its noise insulation report for the planned new subway depot with a brake test route towards Neubiberg to the changed conditions on site.
Because of the deforestation, a large part of the sound insulation in front of Carl-Wery-Straße and the S-Bahn line is now missing.
“Both residents and those seeking relaxation in the Neubiberg environmental garden are shocked at how loud the rail traffic has been since then.” But the trees play no role in the report because the load values are usually calculated according to regulated parameters and are not actually measured on site.
