The majority of the building committee of the Wolfratshausen city council rejects the construction of accommodation for up to 144 asylum seekers in the commercial area.

But even before the vote it was clear: it could still be built.

Wolfratshausen – Accommodation for asylum seekers can be built in the commercial area, on an undeveloped plot of land measuring around 2,800 square meters at Hans-Urmiller-Ring 49.

The members of the city council's building committee rejected the corresponding application from a private investor at their meeting on Wednesday with a vote of 3:7.

But at the meeting it became known that the district office would definitely replace the so-called community agreement of the rafting town.

The vote was preceded by a scandal that culminated in City Hall boss Klaus Heilinglechner (Wolfratshausen Citizens' Association/BVW) depriving SPD city councilor Gerlinde Berchtold of the floor.

However, she gave vent to her indignation, unimpressed.

Ten years ago, the building committee had rejected an almost identical project by the company Moar UG & Co. KG from Bad Wiessee.

“A commercial area is – as the name suggests – a commercial area,” explained current deputy mayor Günther Eibl (CSU) at the time, explaining why residential development was out of the question.

Although the district office determined shortly afterwards that the expert committee's negative decision was illegal, construction did not take place.

Now a new application from a private investor, whose name was not mentioned at Wednesday's meeting, was on the table.

The investor wants to build a “residential complex to accommodate asylum seekers” on the said area, which can accommodate up to 144 people (we reported).

In terms of building law, according to the opinion of the expert committee, the request is watertight.

And in view of the very narrow possible uses of buildings in commercial areas, the Building Code expressly allows “the accommodation of refugees or asylum seekers”.

Mayor: “I trust the district administrator’s word”

“Everything seems to have been complied with,” stated City Councilor Berchtold.

However, she was interested in the answer to the question of whether the initial reception facility for refugees, the multi-purpose hall in Farchet, “will be closed down” when the accommodation on Hans-Urmiller-Ring is finished.

Yes, District Administrator Josef Niedermaier (Free Voters) promised this in a meeting with all mayors, reported town hall boss Heilinglechner.

There are therefore “plenty of witnesses” for this.

Heilinglechner spoke of a “target agreement” that had been made “orally and in writing” between the district office and the city administration.

The district administrator certainly cannot “look into the crystal ball” and reliably predict whether the flow of refugees will ebb or even increase.

But when it comes to the multi-purpose hall, “I trust the district administrator’s word.”

Heilinglechner admitted that “the situation in Farchet is unsustainable for the residents in the long term”.

You, Berchtold, will still not agree to the request.

Just a few weeks ago, the Arbeiterwohlfahrt was refused permission to build a new dementia center in the Loisach industrial park “because of noise protection” (we reported).

“And now families with children have to move to a commercial area – the main thing is that they are accommodated,” said the city council’s social affairs officer.

“Integration has not been talked about for a long time because it can no longer be achieved.”

City hall boss Heilinglechner interrupted Berchtold several times to “not mix social issues with the building committee.”

In addition, a dementia center is a “permanent facility”.

A right of use of twelve years has been agreed for the planned asylum accommodation in the commercial area.

When Berchtold repeatedly started to speak, the mayor harshly cut her off and scolded: “We can all duck away.

Then the government of Upper Bavaria simply throws the wrong documents at our door.” The challenges are great for everyone involved.

Heilinglechner: “We didn’t choose this, neither did the district office and the government of Upper Bavaria.”

Sebastian Sens, an employee in the town hall planning and environment department, explained when asked by BVW parliamentary group spokesman Josef Praller that the city would not set a precedent if the committee approved the building application.

In the future, no one will be allowed to build a “single-family home” in the commercial area.

“Only for refugees,” emphasized Sens, does the legislature allow an exemption from the otherwise irrefutable “type of use”.

Since it was already clear before the meeting that the district office would replace Wolfratshausen's agreement if the expert committee said no to the investor's project, Richard Kugler (Wolfratshauser List) struggled with the city administration's positive resolution proposal.

But for him, Niedermaier's promise to open the multi-purpose hall to athletes again when the accommodation at Hans-Urmiller-Ring is ready for occupancy weighed heavily on him.

“It's a shitty compromise,” said Kugler literally.

There has been no change of opinion in the CSU parliamentary group since 210

“The fact is: it is a commercial area,” stated Second Mayor Eibl.

“But the measure is permitted under building law.” However, there has been no change of opinion at the CSU since 2014.

Looking back, Eibl described the rejection at the time as “wise”, and even now the two CSU representatives on the building committee would not agree to the private investor’s application.

“The district office should replace the community agreement,” said the deputy mayor provocatively.

“Then the district administrator must also keep his promise,” which is to convert the initial reception center in Farchet into a sports hall again.

And if the district office pushes through the construction of the new accommodation against the will of the city, then the district authority “will also be the point of contact for all complaints,” says Eibl.

The situation in Farchet is very tense at the moment.

“It is also not my intention to build refugee homes in commercial areas,” said Mayor Heilinglechner.

“But if we don’t build replacement accommodation, the district office won’t be able to free up any halls.” He knows that “the situation in Farchet is very tense at the moment.”

Heilinglechner appealed to the committee members to approve the building application.

Otherwise, the district office will do this, which will result in a delay in the process of up to three months.

This means: The multi-purpose hall in Farchet will probably not be able to be used again by the BCF Wolfratshausen until later than currently planned.

The district office will definitely replace the community agreement

For city councilor Dr.

Schmidt (“We urgently need more accommodation options for refugees, also to make the Farcheter multi-purpose hall free for the clubs again”) and Ingrid Schnaller (SPD) a coherent argument.

But the majority ultimately rejected the building application.

“We cannot prevent the construction,” said Mayor Heilinglechner.

There is “a clear yes” that the district office will replace the municipal agreement.
