For the Tölz rehabilitation sports club, which got into financial difficulties during the corona pandemic, the dry spell is apparently coming to an end.
The insolvency administrator is now looking for interested parties to take on responsibility on the board.
Bad Tölz - The lawyer Jürgen Müller, who was appointed insolvency administrator by the Wolfratshausen district court in autumn 2020, recently informed the members in writing: “We are over the mountain, are about to conclude the insolvency proceedings and are looking for members who are interested in the office of the board of directors in the association .” In order for the association to continue to exist as such, Müller said, we now need people who are prepared to take on board responsibility.
Interested parties should express their willingness by March 10th by email to him (inso@hingerl.com).
“If there is no interest in the continued existence of the association,” said Müller, “the association could be liquidated and the assets distributed to the creditors.”
In the legal form of the association, he points out to the members, one can "manage difficult economic situations better than in a sole proprietorship or a GmbH, since the association is supported by many who have an interest in its continued existence."
Membership has recovered strongly
Müller rates the club's situation and its business data as favorable.
Thanks to restructuring measures on the one hand and an improved income situation on the other, the concern that the association has no future has now been dispelled: “Full satisfaction of the creditors is on the horizon.” The number of members of the association has recovered strongly again.
It fell from over 200 to 130 during the Corona crisis and has now risen again to over 200.

Full-time employees manage the operational business
The rehabilitation sports club has its training rooms in the attic of the savings bank building on Marktstrasse.
The association currently has four full-time employees, including one full-time and one part-time employee as well as two part-time employees.
An additional position could even be filled if a suitably qualified specialist can be found.
The entire labor-intensive, operational business (training instructions, courses, advice, membership administration, organization, billing and so on) is carried out by full-time employees in the club.
Accounting and all tax processes are outsourced.
From Müller's point of view, the workload associated with taking on a board position and the associated risk are "manageable", especially since this can be insured through board liability insurance after the insolvency proceedings have been completed.
Meeting planned
The further procedure looks like this: As soon as those interested in joining the board have been identified, Müller would like to invite them to a meeting, discuss the business data and vote on any necessary changes to the statutes (for example a significantly shortened term of office for the board).
A meeting of creditors and a meeting of members should then be called to pass all the necessary resolutions.
