The ex-youth coach of TSV Neuried, who sexually abused players, has to go to prison for seven and a half years.

The court rejected preventive detention.

Neuried/Munich – The former youth football coach of TSV Neuried, who abused players, was sentenced to seven and a half years in prison on Thursday.

The judges at the Munich regional court decided against preventive detention, although they consider the defendant to be a dangerous criminal.

On the second day of the trial in mid-January, those involved reached a deal: a prison sentence of between seven and eight years in exchange for a confession.

The defendant then admitted that he had sexually assaulted his protégés (we reported).

After hearing the evidence, the court was convinced that there were 488 sexual assaults and 153 rapes against 25 players between 2015 and 2020.

Sexual intercourse is not necessary for rape; any penetration is sufficient.

Presiding judge Stephan Kirchinger justified the verdict in order to convict for the abuse of those under protection. There was a lack of sufficient “entrustment” of the young people.

The defendant had led the players to believe that they were trained in physiotherapy and asked them to let him treat them.

He carried out the “treatments” at home, in the training camp, but mainly in a club cabin.

He asked the players to undress and lie on a massage table.

After locking the door, he touched the boys and told them this would stimulate their muscles and reduce their risk of injury.

Judge Kirchinger said he “used his position in the club” to commit the crimes.

The ex-coach “did not give an honest statement” about his motivation.

Probably in order to preserve his family, the married father of two children did not admit to “homosexual undercurrents”.

In his last word, the ex-coach almost begged in a halting voice to give him a “future and perspective” with his family.

The public prosecutor's office had requested that preventive detention be ordered.

The defendant confirmed that the defendant committed the crimes not just occasionally, but systematically and was “still dangerous.”

The number of crimes was “insanity”.

However, when making a discretionary decision, it must be taken into account that the ex-coach is “not so jaded” that the long prison sentence “has no effect” on him.

He also shows willingness for therapy.

However, sexual and social therapy can only be successful if he “participates honestly”.

“You have it in your own hands,” Kirchinger tried to motivate the defendant.

And if the therapy is not successful?

The ex-coach would then have to expect not only to have to serve the entire punishment, but also to be placed under managerial supervision afterwards.

Preventive detention as the “sharpest sword of criminal law” is therefore not necessary.

The abuse was discovered when one of the boys confided in his parents.

At the same time, an anonymous report was received by a reporting office.

TSV Neuried then separated from the defendant and filed a criminal complaint.
