"They got into an argument, it got out of hand but there was no reason for her to be charged with attempted second degree murder," Weiner said.



Yalter is currently in custody awaiting a bail hearing.

If she is released, she will have to keep her distance from her husband under a court order, Weiner noted.

During the bail hearing, a public defender who was initially assigned to the case - and has since been replaced by private counsel - downgraded the charges against Berta.

The defense attorney claimed that the state often tries to paint such cases as attempted murder.

"Judge, there is nothing to indicate that she tried to kill him," the public defender said at one point during that hearing.



But the state attorney began reading from the arrest report to justify the more serious charges.

The prosecutor stated that the attempted suffocation with a pillow is an attempted murder in every respect because "the purpose of the action was to suffocate and kill him."

"I think she also admitted to urinating on him," the state's attorney said, "so, I think if you look at the totality of the circumstances, it appears to be more than a fight that got out of hand."
