The massive new building plans for two properties on the corner of Eichtweide and Gartenstrasse in Weilheim are considered “madness” in the town hall.

But the district office does not accept the Weilheim building committee's no.

Which is why the city is now taking a different approach.

Weilheim

- This new building dimension would simply be "too much at this point", the Weilheim city council's building committee agreed at its January meeting: The building applications for two new buildings with a total of eight apartments instead of the current residential building on the Eichtweide property were unanimous 2 and Gartenstrasse 17 rejected (we reported).

As a compromise, it was said, the desired multi-family house would be allowed directly on the Eichtweide and a “classic semi-detached house” to the south, i.e. a total of six residential units - the city building authority should negotiate this with the applicants.

Upper undercuts?

The city of Weilheim doesn't want to give in

But they did not accept the offer to talk, as became clear at the March meeting.

Instead, the district office, as the approval authority, has now announced that it does not follow the city's argument.

In his opinion, the planned buildings fit into the surroundings;

There is currently no development plan for the area.

If the city sticks to its view, the district authority will simply replace the community agreement on the two building applications, is the clear announcement - so: upper trumps lower.

City planning department: “It’s just crazy what’s going to happen here”

However, Weilheim's building committee was by no means willing to give in on this matter on Tuesday morning.

Eight residential units would be too many here, explained Manfred Stork, head of the city's building administration, as there are no such large buildings in the area.

The planning was “exhausted down to the last bit”, the distance areas were “very tight”, the carports were partly at the expense of a terrace.

The city is also critical of the planned “duplex parking” in the garages.

“It’s just crazy what’s going to happen here,” summarized Stork and was surprised “that the district office is retreating to pure legal practice.”

This view was shared by all committee members, across the political groups.

Rupert Pentenrieder (BfW) pointed out that an underground car park would actually be necessary for such a project: “Because it is a divided property, you can get around it.” The planned height development was okay, emphasized several local politicians, but not the building sizes.

CSU city councilor is annoyed that the district office is “showing itself to be so generous here”

“Who do we want to serve?” asked Green Party representative Brigitte Gronau: “the builder who is squeezing out the maximum, or the future residents and residents?” The damage would be “those who live there and everyone around them,” she concluded ;

therefore the project cannot be permitted.

Klaus Gast (CSU) also advocated “not giving consent under any circumstances”, not least because of possible follow-up cases.

He is annoyed that the district office is “showing itself to be so generous here” while it otherwise “pays attention to every dot and comma.”

The city now wants to secure its planning sovereignty with the development plan

When it comes to building, the much-cited planning sovereignty of municipalities is in many cases “long gone,” stated Karl-Heinz Grehl (Greens): “If we still want to have any form of planning sovereignty here, we have to draw up a development plan.” This is exactly what they agreed on Ultimately, the committee also agrees - although the effort is high and the whole thing is difficult given the “inhomogeneous” district (according to Guest).

“We don’t want to prevent development, we just want it to be organized differently,” emphasized BfW spokeswoman Brigitte Holeczek.

The neighboring new development plan “Adlhochstrasse” and the proximity to the Waitzackerbach also need to be taken into account, added Bernhard Kerscher (SPD): “The city has every right to intervene in an orderly manner here.”

In the end there were several votes - all of which were unanimous: the committee again rejected the two building applications mentioned.

A simple development plan should be drawn up that covers the entire area between Moosstrasse, Frühlingstrasse and Gartenstrasse - as well as the properties on the east side of Gartenstrasse.

They also want to impose a change ban for the time being.

The city council will decide on this and the development plan next week.
