Bad Tölz-Wolfratshausen – The driver of a Jaguar was not very careful when maneuvering in the small parking bay.

With two tires, his vehicle was so far on the narrow sidewalk that a stroller or wheelchair couldn't get through.

This was the situation for two employees of the municipal services association who noticed the illegal parking in front of a restaurant in the district.

When they tried to stick the 55 euro fine under the windshield wiper, the situation escalated.

A waiter and a restaurateur are said to have massively insulted and threatened the two men: Both have now been sentenced to fines by the Wolfratshausen district court.

The incident occurred on May 4 last year at around 8 p.m.

The waiter (31) was the first to notice the traffic monitors.

He is said to have stood up in front of the man and called him an “asshole”.

A little later he came back onto the street with his boss (57).

Then things got completely out of hand.

The restaurateur called the official a “wanker” and spat in his face twice during his tirade.

The waiter threatened the second traffic monitor who rushed in: “I’ll beat your eyes bloody.” That’s the accusation.

The waiter reported that he had asked not to pay a ticket because the Jaguar driver was a guest who only picked up food and quickly drove away again.

He did this three times.

“But I didn’t get an answer.

The older of the two just said: “Sneak away, let’s do our work.”

The owner of the restaurant confirmed this version and indicated that they had had “a problem with parking for six years.”

The anger that has persisted over the years over the fact that tickets are constantly being stuck to the windshields of his guests "has now probably been the last straw," the restaurateur's defense attorney later speculated in his plea.

Defendants grudgingly admit the facts

The victims, aged 54 and 42, described in detail the course of events in their witness statements, which they had already reported to the police in May last year.

The prosecution was based on her statements.

After they had once again presented their memories of the warm May evening in court, Judge Helmut Berger asked the two defense lawyers and the public prosecutor to have a “legal discussion” behind closed doors.

The hearing then quickly ended and two other witnesses were dismissed unheard.

Through their lawyers, both defendants explained – visibly gritting their teeth and with a heavy heart – that they “fully admit the facts of the case” and that they are “very sorry”.

“The truth probably lies somewhere in the middle,” explained the restaurant manager’s defense attorney, saying that from his point of view “it was certainly not the case that the injured parties did nothing at all.”

The late confessions enabled the court to impose lenient sentences, namely 90 daily rates of 40 euros each (a total of 3,600 euros) for the restaurant manager and 60 daily rates of 30 euros each (a total of 1,800 euros) for his employees.
