A 21-year-old man from Rottach was sentenced to a suspended sentence by the jury.

The judge recognized his efforts in therapy.

Rottach-Egern

– A 21-year-old from Rottacher had to answer before the lay judges court in Miesbach for drug trafficking.

The indictment contained three points.

In the first case, a Kreuther discovered a plastic bag containing 385 grams of marijuana hidden on his property and called the police.

Due to drug influence: Rottacher doesn't remember

DNA traces of the defendant and two other people were found on the bag, which contained 80 bags of drugs.

The defendant said that at the time, shortly before starting therapy, he wanted to break free of his drug past and therefore gave the ziplock bags to friends.

That's why his traces were found on it.

But he couldn't remember any details because he was still under the influence of drugs at the time.

His claim that he had merely handed the empty bags over to a friend, who must have provided the discovered drugs, was met with some skepticism by the prosecutor and judge Klaus-Jürgen Schmid.

Rottacher's lawyer explained that her client began using drugs at the young age of ten to numb the grief over the death of a family member.

Then he got into the wrong circles, but now wanted to change his life and therefore went to rehab with a self-help group.

Defendant attacked because of money debt

The second case took place in a hotel in Munich.

The 21-year-old said he took a room there with a friend and his girlfriend to “chill out for a few days.”

But during a check, the police found drugs on them.

According to the indictment, there were two slabs of hashish, each weighing around 100 grams, and around 25 grams of marijuana.

One of the two plates was able to be assigned to the defendant himself, said a chief detective involved in the investigation.

The defendant's friend called the police on the scene when he offered both hashish plates for sale on the Internet under his name.

The Rottacher said he got the drug plate from a colleague whose name he did not want to name.

He asserts that the drug was intended exclusively for his own consumption.

He didn't pay anything for it because he often referred customers to the colleague in question.

He claimed to have known nothing about the planned sale on the Internet - which in turn did not seem credible to the public prosecutor.

In the third case, the defendant himself sought the help of the police.

Here he is said to have bought 50 grams of marijuana in Irschenberg.

But then he was attacked by the dealer near Bad Tölz because he owed money in this matter, the police officer reported.

Defendant already has a criminal record - court sentences him to probation

The representative of the juvenile court service reported a difficult family history and multiple failed attempts to beat the addiction.

He recommended that juvenile criminal law be applied.

The court ultimately decided to uphold only the second charge, the drug discovery in the Munich hotel.

The five-time convicted person received a standard juvenile sentence of one year and eight months on probation, including an open criminal record, as well as the requirement to continue his therapy and begin vocational training as soon as possible.

His stay in the facility suggested a better path and had just saved him from a prison sentence, said Judge Schmid.
