Now another verdict is imminent.

The judges had many questions for the state capital - and did not find all the answers satisfactory.


Munich - The Bavarian Administrative Court has decided to postpone the ruling on tightening the diesel driving ban in Munich for a week, reports the German Press Agency.

Although the Senate was already ready to make a decision after numerous critical questions to the state capital, it still wanted to wait for the final version of a new draft resolution for the Munich city council in order to be able to give it clear guidelines.

The city council plans to address the low emission zone and measures to combat air pollution again on April 24th.

The air in Munich is not clean enough in all places - but the diesel driving ban is still not being tightened

The air quality in Munich was also not sufficient in some places last year.

However, the city administration has not yet implemented a gradual tightening of the agreed diesel driving ban.

This led to lawsuits from the German Environmental Aid (DUH) and the German Transport Club (VCD).

Since February 2023, diesel vehicles with the Euro 4 standard and worse, with some exceptions for residents and delivery traffic, are no longer allowed to drive on and within the city's middle ring.

Originally, the driving ban was to be extended to diesel vehicles with the Euro 5 standard from October, and from April 2024 the general exceptions were to be eliminated.

Munich city council decided to suspend or lift two further tightening measures of the ban

However, in September the city council decided to suspend stage 2 until May and to abolish stage 3 entirely.

This was justified by the fact that the first stage of the ban would probably be sufficient to comply with the annual average limit for toxic nitrogen dioxide (NO2) of 40 micrograms per cubic meter of air.

After discussing formal legal aspects, the court asked many critical questions about the calculation basis of the report.

In particular, the judges were not convinced by the forecasts regarding traffic figures, the composition of the transport fleet and the effects of a bus lane.
