In mid-February, Cédric Jubillar's lawyers filed a request for recusal, considering that the judges in charge of the case were no longer "legitimate" to handle the case. The deadline by which the Toulouse justice system must rule is approaching.


On February 13 and 15, Cédric Jubillar's lawyers initiated two legal actions to challenge the investigating judges in charge of the Jubillar case, Audrey Assémat and Coralyne Chartier.

The Toulouse courts then had one month to make a decision: the decision concerning this extremely rare procedure should soon be made public.

If the request is accepted, two other investigating judges will be appointed.

At issue: a sentence slipped into the indictment order affirming that

“Cédric Jubillar is the author of the murder of his wife”

.

In other words, according to the investigating judges, the Cagnac-les-Mines nurse Delphine Jubillar was killed on the night of December 15 to 16, 2021 by her painter-plasterer husband, without a shadow of a doubt .

“They can no longer be considered impartial”

Shocked by this assertion, the defendant's lawyers, Me Emmanuelle Franck and Me Alexandre Martin, had not only filed a request for recusal with the first president of the Toulouse Court of Appeal, but also filed an appeal before the Court of cassation against the decision to resume investigations.

On February 8, the Court of Appeal ordered new investigative actions to be carried out.

Audrey Assémat and Coralyne Chartier were then asked to carry out these investigations.
