Berlin – Since September 16, 2022, two subsidiaries of the Russian energy company Rosneft have been under trust management by the Federal Network Agency.

Just a few days ago, the traffic light coalition announced that it wanted to extend this measure by six months.

The parent company Rosneft then sued.

Federal Network Agency takes over German subsidiaries of Rosneft

Specifically, it is about Rosneft Deutschland GmbH (RDG) and RN Refining & Marketing GmbH (RNRM).

Following an order from the Federal Ministry for Economic Affairs and Climate Protection on September 16, 2022, the Federal Network Agency took control and justified this with the Energy Security Act.

The step is necessary to ensure the energy supply within Germany.

At the same time, the measure was intended to prevent the “refusal to provide operationally necessary services from affecting business operations, especially with regard to critical operational processes.” At least that is what the Federal Network Agency said.

In plain language: The government was worried that the Russian company could exert pressure on Germany through its subsidiaries.

Important crude oil suppliers had also threatened to terminate business relationships if control reverted to the Russian company.

Rosneft at the largest oil processors in Germany

In the current case, it is not about the original decision, but rather about the federal government's measure of March 15, 2023. That was when it decided to extend the trust management of RDG and RNRM by the Federal Network Agency.

The government also stated the same thing on March 7, 2024 - the trust administration should now continue until September.

“The Federal Network Agency thus retains control over Rosneft Deutschland and thus also over the respective share in the three refineries PCK Schwedt, MiRo (Karlsruhe) and Bayernoil (Vohburg),” the federal government said.

Rosneft Germany accounts for a total of around twelve percent of Germany's oil processing capacity and is one of the largest oil processing companies in the country.

With this extension, the government wants to address the “continuing threat to energy supply security”.

The federal states of Berlin and Brandenburg are particularly affected.

The process is on hold

The Russian oil company Rosneft has now filed a lawsuit against this extension of the trust administration.

The Malmendier law firm commissioned by Rosneft told the Reuters news agency that the focus was on the “factual and legal situation of March 15, 2023”.

The lawsuits against the trust administration are now on hold.

At the request of those involved, the procedures for the first and second extensions were suspended, the

news agency reported , citing a spokeswoman for the Federal Administrative Court in Leipzig.

No lawsuit has yet been filed against the third extension, which the federal government announced on March 7th.

The proceedings should now be suspended until those involved demand a continuation.

A year ago, the Federal Administrative Court had already declared the first phase of the trust order to be legal.

The traffic light had also played with the expropriation of Rosneft.
