A Tölzer must serve a prison sentence of six months.

A previously convicted Tölzer (40) has to go to prison for six months.

- The public prosecutor was of the opinion: "It's enough." Despite two open probations, the man had committed another offense against her - now he should sit.
According to the prosecution, Tölzer (40) is said to have kicked a neighbor's door forcefully, then insulted the woman and threatened her: "I'll take out my knife and ram it into you." The court saw it like the prosecutor and convicted him Koch was sentenced to six months in prison for damage to property and insults - and this time without a chance of parole.

The defendant, who had multiple previous convictions, admitted that he had kicked the door.
“I insulted her too,” he admitted.
"But the rest is a lie." The reason for the action was probably that the accused's alcohol level was too high ("I felt very drunk after about six half a half") - combined with the fact that the injured party who lived above him was " “Stomping on the floor” wanted to ensure peace.
“I was angry,” explained the 40-year-old.
The defendant was an “emotionally unstable personality,” said his probation officer.
“Especially if he had something to drink.” The probation conditions included a ban on alcohol and psychotherapy.
“It is questionable whether he will stick to it.” At least on the night of October 13th to 14th last year, the accused said he had indulged in alcohol extensively as he left.
“At some point he loses control,” the probation officer explained

Public defender Andreas Sander emphasized that his client was seriously ill and needed treatment.
“If you don't do anything, he will remain a bomb.” Judge Helmut Berger shared these concerns, but also said with regard to the probation conditions: “We tried, but if he doesn't cooperate, we have no choice. “

By sentencing him to six months in prison, the judge fell short of the prosecutor's request, which had asked for three months more.
He gave the defendant advice that he should “present something before the appeal hearing at the regional court: a job, psychotherapy, proof of abstinence from alcohol.”
