On the A99: PV system without any building application

2024-03-15T09:16:16.235Z

Highlights: A PV system will be built south of the A99, to the right and left of Siegertsbrunner Weg. Following a change in the law, construction is now possible without a development plan. The planned PV system is located up to 200 meters away from the motorway, which is why the project does not require any approval. The necessary compensatory measures under nature conservation law and species protection law were coordinated with the responsible lower nature conservation authority. The area should be enclosed and integrated into the landscape through planting so that the landscape is not impaired.

A private citizen is allowed to build a ground-mounted PV system on an area on the A99.

And all without a building application.

Putzbrunn - In spring 2022, a private individual applied to be allowed to build an open-space photovoltaic system south of the A99, east and west of Siegertsbrunner Weg.

At the end of June 2022, the municipality initiated the preparation of a development plan, which was necessary at the time.

“In the meantime, the law to immediately improve the framework conditions for renewable energies in urban planning law has made open-space PV systems along motorways and at a distance of up to 200 meters from them privileged projects,” explained Mayor Edwin Klostermeier (SPD) recently in the building committee.

The planned PV system is located up to 200 meters away from the motorway, which is why the project does not require any approval and the municipality's land-use planning can therefore be terminated.

The necessary compensatory measures under nature conservation law and species protection law, which are set out in the landscape conservation accompanying plan, were coordinated with the responsible lower nature conservation authority.

The area should be enclosed and integrated into the landscape through planting so that the landscape is not impaired.

“Since the client has declared the dismantling obligation and the electricity supply line has also been clarified, I assume that the PV system will be built there relatively soon,” said Klostermeier.
