Life-threatening attack or self-defense – this was the question at the start of a trial at the Landshut regional court for attempted murder.

Erding/Landshut - A 49-year-old man is accused of attacking an opponent with a broken bottle in workers' accommodation on June 15, 2023.

The Romanian first asked for understanding in court.

A bit of gossip is normal when several people sit together.

He himself didn't even make any disparaging comments when his friend and his father-in-law said goodbye to the small barbecue.

The situation escalated.

After prosecutor Julia Knauer read out the charges, the 49-year-old began with an explanation.

“First of all, I would like to say that I am happy that we are finally here today.” He has been in custody since the incident and he wants to clarify a few things.

When asked by presiding judge Ralph Reiter about the accusation, the 49-year-old said: "That's a lot of fantasy." The public prosecutor, however, sees it as proven that the Romanian was in the workers' accommodation in Erding around 10 p.m. on the day of the crime with a broken one He had stabbed his acquaintance with a wine bottle.

With this he gave his opponent two deep cuts on his cheek.

He was able to dodge backwards, which is why he did not suffer any life-threatening injuries.

But the defendant could also have hit the vital carotid artery.

After the bloody hits, the guests separated their opponents.

The defendant got a knife from the kitchen and went to his room with it, where he is said to have said to a witness: “I'm going to stab him.”

The defendant, in turn, assured that he had only taken the knife into the room to protect himself.

He expected that the injured party would be angry with him because of the cuts and would confront him.

Instead, the police knocked on the room door.

The knife was wedged behind a bed base, one of the officers reported in court.

However, defense attorney Patrick Schladt pointed out that the interrogations in the workers' accommodation were conducted “suboptimally.”

Another witness acted as an interpreter for the police.

The defendant denied in court that he had deliberately stabbed him and presented the incident as a self-defense situation. "If I had actually intended to hurt him, then he would no longer be recognizable today." The acquaintance approached him threateningly and was about to to beat him.

Then he broke the bottle to intimidate him.

Even when two people held him, the defendant still tried to hit him “around the bottle”.

He therefore had to repeatedly make evasive movements because he had the wall at his back.

The cut was probably accidentally caused.

Those involved in the proceedings have to wait another week for the injured party's version: the man did not appear despite being summoned.

The trial continues on March 19.

The question that will also need to be clarified is what role alcohol played in the crime.

In a letter to the public prosecutor, the 49-year-old wrote that he “would have handled the situation differently without alcohol.

I need therapy.” He explained that he had already gotten some tablets to combat his addiction.
