According to a model judgment, 19 Erdingers have claimed back fines in the wake of the Corona exit restrictions - completely without success.

Erding - It wasn't that long ago and yet it seems like it's out of time: in spring 2020, the first Corona wave rolled across the country.

Exit restrictions should act as a breakwater.

The Federal Administrative Court classified the one from April 2020 as disproportionate a year ago.

The Leipzig judges thus cleared the way for citizens to demand back fines.

Also in the Erding district.

“The district office has received 19 applications for reimbursement of fines due to the judgment,” reports its spokesman Markus Hautmann when asked by our newspaper.

With moderate success for those who were sanctioned at the time.

“17 applications were rejected as unfounded,” Hautmann continues.

Two were forwarded by the district office to the government of Upper Bavaria as part of clemency proceedings.

However, they were turned away there, said Hautmann.

The ruling referred to cases in which citizens were fined for being outdoors alone or with household members without a valid reason.

There are several thousand cases reported across Bavaria.

The Leipzig ruling does not include cases in which friends met during the curfew.

Erding never fully exhausted the scope of the punishment.

The Bavarian catalog of fines provided for up to 150 euros.

According to the spokesman, only 75 euros were charged in the district.

According to Hautmann, the district office issued fines totaling up to five figures.

“But this never affected individual citizens, but primarily airlines if they violated testing or certificate requirements during the pandemic,” said the spokesman.

The Erding district court has proven to be quite resistant to the pandemic.

“We have had almost no complaints against fine notices,” reports director Ingrid Kaps.

The cases were predominantly handled by the district administration authorities.

There have only been a few lawsuits in connection with the pandemic, for example this January against a doctor because of false recovery certificates.

The applicants who have now failed can of course still appeal to the judiciary, but then to the administrative courts.

When it came to compulsory corona vaccination, District Administrator Martin Bayerstorfer demonstratively refused to allow official enforcement - the exemption of unvaccinated clinic staff.
