Munich – The Bavarian judiciary is currently dealing with the use of artificial intelligence (AI) at universities.

Three prospective students who were rejected by the Technical University of Munich (TUM) due to the alleged use of AI in their applications have lodged a complaint, a university spokesman told the

An urgent application has already been rejected by the Munich Administrative Court, as the court confirmed.

According to the administrative court, an urgent application from two other people “regarding deception through the use of AI at TUM” is still pending.

The text was full of information, despite its brevity, and was written “in almost error-free, polished English.”

The examiners were suspicious because the application text differed greatly from the essay that the applicant had submitted in an unsuccessful application the previous year.

Munich student uses AI for applications: complaint lodged

“During the proceedings, the applicant was unable to provide any other comprehensible explanation for these abnormalities, which suggest the use of AI in the creation of the essay,” the court said in response to a dpa request.

An urgent application was rejected at the end of November 2023 and the main proceedings did not take place because the plaintiff withdrew his lawsuit, according to the court.

The two other alleged AI cases in which TUM is facing lawsuits are similar to the case that has already been decided, according to a university spokesman.

Alexander Fehr, managing director of the Association of the University of Bavaria eV, stated that he was not aware of any other similar procedures.

The association has set up a working group “in which lawyers from universities who deal with student affairs exchange ideas”.

However, so far the Bavarian universities have not decided on a “coordinated approach in the legal sense”.

“However, this does not mean that we will not work more closely together on this topic in the future, including during applications and examinations,” said Fehr.
