In the Geretsried building committee, Mayor Michael Müller clarified statements from the Wolfratshausen citizens' meeting regarding the tree protection ordinance.

Geretsried - An item on the agenda of the city of Wolfratshausen's building committee, which recently dealt with the tree protection ordinance, prompted Mayor Michael Müller (CSU) to clarify this in the Geretsried city council on Tuesday evening.

The reason for this was a request from the Wolfratshausen citizens' assembly that Wolfratshausen should have a tree protection ordinance based on the model of the city of Geretsried.

As reported, Wolfratshausen's mayor Klaus Heilinglechner said that Geretsried handles the tree protection ordinance, which was introduced in 2013 and last revised in 2023, "quite loosely".

“As examples, he cited the felling of trees in connection with the construction of the inter-communal indoor swimming pool and the adjacent parking garage,” Müller quoted from the article in our newspaper at the meeting.

It also said that the statutes “demonstrably do not work” in Geretsried.

The statements from Wolfratshausen now prompted the Geretsried town hall boss to make a correction: “Two things are being mixed up here,” Müller clarified.

During the construction of the indoor swimming pool, forest was removed as part of the land-use planning.

This forest was balanced elsewhere.

“The tree protection ordinance does not apply to forests,” said the mayor.

According to the Federal Forest Act, felled forest must always be compensated for by forest.

In contrast, the tree protection ordinance covers other urban trees.

If they are felled (with approval), replacement planting would have to be carried out.

City planning officer Rainer Goldstein also commented on the issue: “You have to keep things separate.” If forests are cleared, they always have to be compensated for through area compensation.

“We have an eco-account for this.” The tree protection ordinance, on the other hand, applies to individual trees within built-up districts.

Müller emphasized: “A tree protection ordinance does not, of course, prevent the illegal felling of trees.” He referred to a case in Gelting in which 19 trees worthy of protection were felled in 2022.

On the other hand, a tree protection regulation does not prevent the felling of old and diseased trees or construction projects.
