A 64-year-old pensioner from Wolfratshausen drives home with a blood alcohol level of 1.3 per mille, is picked up by the police and is now sentenced in the district court.

She found the 64-year-old pensioner at his home a good hour later.

The blood sample that was taken from the drunk showed a level of 1.7 per mille.

Therefore, the Wolfratshauser had to answer before the district court for negligent drunken driving.

He was sentenced to a fine of 1,000 euros and had to forego his driving license for a total of eleven months.

The senior explained the high blood alcohol level with a so-called after-drink.

He explained in court that he had consumed two or three beers at home on that summer night at the end of August last year after his return before the police rang his doorbell.

He only claims to have had “two cokes with vodka” in the bar.

Both statements appeared doubtful because the drinks would not have had the 1.7 per mille level determined nor the 1.3 per mille level that he must have had at the time of the crime (when he left the bar and got into the car) if the alleged night drink were deducted .

As a medical expert confirmed, the values ​​corresponded more closely to the drinks that the waitress brought the gentleman: “Several mixed drinks, beer with rum, Campari with grapefruit, always very, very strange mixtures, in pilsner glasses.”

Judge Helmut Berger had no doubt that the Wolfratshauser driver had driven his Renault car home with at least 1.3 per mille of alcohol in his blood.

As a result, he sentenced the pensioner to a fine of 50 daily rates of 20 euros each for negligent drunk driving and ordered a driving license suspension of a total of eleven months.
