In a drug trial before the Munich II Regional Court, a judge wants to wait for the law on marijuana possession to be amended before announcing the verdict.

On April 1st, adults are allowed to keep 50 grams at home for private possession.

Three young drug dealers were caught in Garmisch-Partenkirchen with ten times that amount.

But legalization shifts the punishment range in their favor.

The three young men (19 and 20 years old) would have liked to complete their joint drug trial before the Munich II Regional Court before Easter.

But the recent decision to legalize cannabis made this pointless.

And so the presiding judge Martin Hofmann decided: The verdict will not be made until April 12th.

Because on April 1st, the punishment range will also shift - in favor of the defendants.

All three previous judgments should have been reopened and decided again.

The men smelled of marijuana

On the second day of the trial, police officers and experts passed on their knowledge of the case.

At the end of May 2023, the trio bought almost 500 grams of marijuana and 10 grams of cocaine at night in Starnberg (we reported).

The boys drove back to the market town.

When a police patrol stopped next to the BMW at a traffic light on Bahnhofstrasse, the youngsters in the big car were immediately noticed.

One had glassy eyes and was shaking.

The officers didn't wait long and checked the teenagers and the vehicle.

The same men smelled of marijuana.

The officers found the drugs in question in a backpack.

The three hotel trainees were arrested at short notice, and the 19-year-old is the only one still in custody today.

He made a few missteps behind bars, engaged in illegal gambling and took part in an illegal table tennis tournament in which the winner was supposed to receive a prize.

“I have been in prison for ten months.

It wouldn’t be worth it to me today,” he said, trying to convince people that he didn’t want to do any more illegal business in the future.

While in custody, everyone suffered from depressive moods

Apparently the isolation in prison also took a toll on him.

Like his colleagues, he had temporarily suffered from a reactive, depressive mood.

According to a doctor, it wasn't so severe that the 19-year-old needed treatment.

He did not request inpatient therapy in the future either.

But he is receptive to a little advice.

Various substances were detected in the hair and urine of the men from Garmisch-Partenkirchen.

Each of them had three previous convictions.

They stole and demolished vehicles.

Among them was a VW Bully from the German Ski Association.

The minimum penalty is one year

With cannabis legalization, which allows possession of 50 grams of cannabis at home, the penalties will be reduced significantly.

In the current case of drug possession alone, the penalty range falls from five years to a minimum sentence of one year.

In order to be able to make a judgment in April according to fresh legal conditions, the two hearing dates scheduled for this week were canceled.
