An aggressive driver has now been sentenced to a fine in the Ebersberg district court.

The judge sees “fairy tales from a thousand and one nights” in the defendant’s statements.

Because he harassed and injured walkers, he has now been sentenced to a fine in the district court.

- On an evening in July 2022, a couple was taking a walk on a small street without a sidewalk near Hirschbichl.

Suddenly a car came towards him and drove past him.

The vehicle struck the man on the elbow.

Then the person responsible, a man from the southern district (born in 1984), suddenly turned around and came back on the wrong side of the road.

Like a “ghost driver,” the affected woman reported in front of the Ebersberg district court when she described the incident on Tuesday.

The car window was rolled down and the driver started an argument.

“We’ll deal with this now,” he is said to have shouted several times.

The couple tried to escape the argument and went to a nearby company property.

The driver followed him in a company car that he has as a service employee.

There were two “contacts” with the vehicle.

The walker fell to the ground.

Injured himself.

When the witness came, he packed the device back up.

“More could have happened,” the lawsuit says.

The woman alerted the police.

Her husband shouted at the attacker: “Go away,” which he then did.

Nevertheless, he was investigated.

Defense attorney referred to an exceptional personal situation

The defendant's defense attorney explains his behavior on the day of the crime as an exceptional personal situation.

But the man is not a blank slate.

He has nine previous convictions, including assault on several occasions.

In the present case, not all of the allegations could be proven to have been intentional.

In case of doubt for the defendant, said Judge Gellhaus.

“But I’m unsure whether that got through to you.” The judge describes some of the defendant’s statements as “fairy tales from the Arabian Nights.”

The defendant's fuse was very short that evening.

Those affected are still suffering

Shortly before the trial, the defendant apologized to those affected in a letter.

He announced financial compensation.

There is talk of 750 euros in the negotiation.

The defendant has cash with him, which he shows to the judge upon request.

The apology letter was a computer printout and was not signed.

Reaction of the woman concerned: “Two weeks before the hearing.

They have not understood the situation to this day.” According to their own statements, the couple is still suffering from the consequences of what happened in July 2022.
