How dense can residential buildings be in the old town?

This was the question that was at stake when Weilheim's building committee recently decided on a request for Hofstrasse.

What the applicant would like to do in a rear building is “too much” for most committee members.

Weilheim - It's about an existing outbuilding in the rear area of ​​the property at Hofstrasse 3, in the middle of Weilheim's old town.

The fact that this can be converted into a residential building and reused was already approved in 2019: It is therefore permissible to create a small penthouse above the second floor in order to open up a roof terrace planned there.

In the meantime, however, the property had been sold, it was said at the most recent meeting of the city's building committee, and the new owner had submitted a slightly different building request: He wanted to build a "full-fledged third floor" with a flat, sloping pent roof instead of a roof terrace and penthouse, explained City building department employee Stefan Kirchmayer.

He added that the existing buildings on the property “already do not comply with the legally required distance areas in their existing form”.

But the necessary fire protection would still be “well maintained” even with the change – the district office will have to check this.

Contrary views at BfW and CSU

The city council's building committee was now asked whether it would give community approval for the planned "increase".

And there were different opinions on this.

In view of the narrowness in this area, the expansion was “absolutely too much,” said BfW spokeswoman Brigitte Holeczek: This would probably create another residential unit, which would also have consequences in terms of car parking spaces.

And the latter could only be replaced because there was no space for it locally.

This is “normal in the old town area,” countered CSU representative Klaus Gast – and found the “increase” okay: Although there is monument protection all around, “but no one is bothered by it in this area, it cannot be seen.”

And “additional residential use without additional sealing is good,” Gast continues.

“Living in the old town is one of the most beautiful ways to live,” said Karl-Heinz Grehl (Green Party).

That's why there's nothing wrong with the project, "as long as it doesn't affect the neighbors": "Air and light still have to come in."

But the increase would “certainly have an impact” for at least two neighbors, Kirchmayer replied: “I can’t say whether it is unreasonable.

But I have my concerns.” The district office must decide whether it is reasonable, added city architect Katrin Fischer.

But the situation would certainly be made worse with the desired expansion: “That definitely goes beyond what is actually provided for by law.

That's why we view it rather critically." In addition, the solution planned so far with a roof terrace is "actually good," says Fischer: "There is no other outdoor area there."

Green city councilor Brigitte Gronau thanked her for these “clear words”: She initially thought the increase was conceivable, “but if it harms others, it should be rejected.”

That's exactly what the majority of the building committee did - and outvoted the two CSU representatives who voted for the expansion.
